Comparative Negligence in Lyft Accidents
Lyft accidents, just like car accidents, operate on a modified comparative negligence rule under the Official Code of Georgia Annotated (OCGA) § 51-12-33. This rule means that you have to be less than 50% responsible for your accident occurring to file a claim to win a settlement.
You most likely won’t have to worry too much about being responsible for your accident if you were the passenger of the Lyft. Still, there are times when the at-fault party responsible may try to shift the blame towards you. So, be prepared to prove your innocence even if you have solid proof against the party responsible.
Who You Can Hold Liable for Your Stone Mountain Lyft Accident
Despite using Lyft, there are times when they may not always be at fault. There are other parties that can be responsible for your accident, such as:
- The Lyft driver
- The vehicle manufacturer
- Another negligent driver on the road
Remember, you don’t have to file a claim against Lyft directly if any other party was primarily to blame. If multiple parties were somehow involved in your Lyft accident, you can hold them all liable. It can be confusing to know how to determine fault. Don’t worry. Our Lyft accident lawyers in Stone Mountain can help you go through your accident and figure out who caused it and how.
Receiving Compensation for Your Damages
You can factor any damages into your settlement, including:
- Medical expenses
- Property damages
- Lost wages
- Pain and suffering
- Mental anguish and emotional trauma
- Loss of consortium
- Loss of enjoyment of life
- Wrongful death
- Disability and disfigurement
Always remember that any damages related to your Lyft accident can get factored into your settlement. They don’t strictly have to be on the list above. As long as you have solid proof of your damages and can demonstrate their impact on your life, you should be able to get them all compensated in your claim.

How Our Stone Mountain Lyft Accident Lawyers Can Help You
Our Lyft accident lawyers in Stone Mountain can do way more than just file paperwork for your claim. We take a proactive and dedicated approach to all the cases we handle for our clients.
Collecting Evidence
We can collect evidence on your behalf for your Lyft accident. While you focus on your recovery from your accident, our lawyers will be hard at work gathering surveillance footage, witness testimonies, and official documentation of your accident. From there, they can mount a successful claim against the insurance company for a fair settlement.
Handling All Your Communications
Many Lyft accident victims make the mistake of saying too much to an insurance adjuster or accidentally agreeing to things that can compromise the integrity of the claim they filed. We can handle all your communications with other parties for you, so these mistakes don’t happen.
Calculating Your Damages
Calculating your damages accurately is more of a complex process than it seems. We use various formulas and take into account the context and circumstances surrounding your Lyft accident damages to create a proper settlement amount on your behalf. We will never leave any of your damages out of your final settlement total.
Understanding the Merits of Your Lyft Accident Case
Car accident and personal injury law can be very complex to the average person. Instead of spending hours on end trying to learn all the legal jargon and processes that go into getting a proper settlement, leave it all to us. Our lawyers will be there every step of the way and keep you involved in the entire process.
Don’t Trust Insurance Companies
Insurance companies are notorious for always trying to get away with paying you less, and the insurance companies that cover Lyft are no exception. So, if you don’t want to end up with a lowball settlement, never accept their initial offers of compensation. Instead, get the legal assistance you need to ensure that you get fairly compensated for all your damages.
Statute of Limitations for Lyft Accidents in Georgia
Under OCGA § 9-3-33, Lyft accident victims in Georgia only have two years to file their claims. This isn’t a lot of time in the grand scheme of things. Therefore, right after you receive medical treatment, we urge you to reach out to one of our Stone Mountain Lyft accident attorneys as soon as possible for a free case review at no risk or obligation to you.
