Lithonia Personal Injury Lawyer

Did someone else’s negligence or recklessness cause you to get hurt? At John Foy & Associates, we understand the importance of legal representation for victims of personal injury accidents.

Since 1999, our attorneys have focused on representing people just like you. With 350 years of combined experience, we have recovered more than $1 billion for our clients. We can fight for your rights and pursue fair compensation as your Lithonia personal injury lawyer.

How Lithonia Personal Injury Lawyers Can Help You

An injury claim is rarely as simple as telling an insurance company what happened. The insurer has an interest in limiting what it pays, while you have an interest in recovering the losses caused by your injury. Lithonia personal injury attorneys can take over communications with insurers and other parties while building your claim. Here’s what that work might include:

• Reviewing accident reports
• Gathering medical records
• Identifying witnesses
• Examining photographs or video
• Researching applicable laws
• Calculating financial losses

Your personal injury lawyers can also determine who could be legally responsible. In some cases, that is another driver. In others, it could be a property owner, employer, manufacturer, medical provider, business, or another person or organization.

The value of legal representation is not limited to negotiations. If the insurer refuses to make a reasonable settlement offer, your attorney can also discuss litigation and, when appropriate, pursue the case in court.

The Types of Cases Our Lithonia Personal Injury Law Firm Handles

Let’s take a closer look at the personal injury cases our attorneys can handle:

• Lithonia car accident lawyer: Car crashes can happen on local roads, intersections, and throughout DeKalb County. When another driver’s distracted driving, speeding, impaired driving, failure to yield, or other negligent conduct causes a collision, our attorneys help injured people pursue compensation.
• Lithonia truck accident lawyer: Commercial truck collisions can result in severe injuries because of the size and weight of these vehicles. Our attorneys investigate crashes involving negligence while helping injured victims pursue compensation for their losses.
• Lithonia workers’ compensation lawyer: A workplace injury can leave you unable to work while medical bills continue to arrive. Georgia’s workers’ compensation system provides benefits for qualifying job-related injuries. Our attorneys help injured workers address problems that can arise when seeking workers’ compensation.
• Lithonia slip and fall lawyer: Property owners and occupiers have legal responsibilities toward people who are lawfully on their property. When a dangerous condition contributes to an injury, our attorneys investigate whether the responsible party knew or should have known about the condition and failed to address it.
• Lithonia wrongful death lawyer: Losing a family member because of another person’s negligence can bring profound grief and unexpected financial losses. Our attorneys help eligible family members understand their rights, investigate the death, identify potentially responsible parties, and pursue compensation through a wrongful death claim.
• Lithonia defective product lawyers: A defective or dangerously designed product can cause serious injuries even when someone uses it as intended. Our attorneys can investigate whether a product-related issue contributed to the injury and determine which parties could be held responsible.
• Lithonia medical malpractice lawyers: Medical treatment does not always produce the expected result, but an injury caused by a healthcare provider’s failure to meet the applicable standard of care can support a medical malpractice claim. Our attorneys can help determine whether negligence caused additional harm.
• Lithonia prescription error lawyers: Receiving the wrong medication, an incorrect dosage, or a prescription that creates a dangerous interaction can cause serious harm. Our attorneys can review evidence to determine how the error occurred and whether a healthcare provider, pharmacy, or another party could be responsible.
• Lithonia assault injury lawyers: An assault can leave victims with physical injuries, medical expenses, lost income, and lasting emotional effects. A criminal case and a civil personal injury claim are separate matters, and our attorneys can help injured victims understand whether they have grounds to pursue compensation from a liable party.

The circumstances surrounding an injury are different for every person, and the laws that apply can depend on how and where the incident occurred. As your personal injury attorney in Lithonia, we can review the details of your situation, explain the legal options available to you, and help you understand what pursuing a personal injury claim could involve.

Lithonia and the City’s Role in DeKalb County

Located east of Atlanta, Lithonia is a community in DeKalb County surrounded by a mix of residential neighborhoods, commercial areas, major roads, and local businesses. People in Lithonia can encounter injury risks in many parts of everyday life:

• Driving through busy intersections
• Shopping at local businesses
• Working at job sites
• Visiting someone else’s property

The circumstances of an accident can affect who is legally responsible and what evidence is relevant to a claim:

• A collision could involve another driver, an operator, or multiple parties.
• A fall could involve a property owner’s failure to address a dangerous condition.
• A workplace injury could fall under Georgia’s workers’ compensation system.

Other injuries could involve defective products, medical negligence, prescription errors, or intentional acts. For someone who’s been injured, identifying the responsible party is only one part of the process. You also need to establish how the incident happened. Your personal injury lawyers in Lithonia can help by:

• Connecting the incident to your injuries
• Documenting your financial losses
• Determining which laws apply
• Using local records, photographs, video footage, witness statements, medical records, and other evidence to help establish what happened

Common Sources of Injury in the Lithonia Area

Personal injuries can happen in many different settings throughout Lithonia and the surrounding DeKalb County community. Traffic accidents can occur on local streets or major routes, while commercial properties can expose visitors to the following hazards:

• Wet floors
• Uneven surfaces
• Inadequate lighting
• Poorly maintained walkways

Workplace injuries can happen in offices, warehouses, construction areas, retail businesses, and other employment settings. Product-related injuries can arise when a defective item causes harm during ordinary use.

Medical injuries can involve errors in diagnosis, treatment, medication, or other aspects of patient care. The legal process looks different depending on what caused the injury. That is why the evidence collected after an accident should reflect the circumstances involved.

Property Owners Can Be Responsible When Visitors Get Hurt

A fall or other injury on someone else’s property can raise questions about whether the owner or occupier knew about a dangerous condition and failed to address it. In Lithonia, these claims can involve the following locations:

• Businesses
• Apartment complexes
• Restaurants
• Stores
• Parking lots
• Private properties
• Other locations open to visitors

The condition that caused the injury should be documented when possible. Photographs can show the location and appearance of a hazard, while surveillance footage or witness statements could provide information about how long the condition existed.

Medical records can also help establish the nature and extent of the resulting injuries. Property owners and occupiers do not automatically become responsible for every accident that happens on their property. All of these circumstances can affect your claim:

• The circumstances surrounding the incident
• The conditions involved
• What the property owner knew or should have known
• The injured person’s own actions

If you were injured because of a dangerous condition on someone else’s property, our [Lithonia slip and fall lawyers](/areas-we-serve/lithonia-ga/slip-and-fall-injury-lawyer/) can review the circumstances and help determine what legal options could be available.

Families Can Face Financial Losses After a Wrongful Death

When an accident or other wrongful act results in someone’s death, surviving family members can face losses beyond the immediate grief of losing a loved one. Medical expenses, funeral costs, lost income, and the loss of financial support can create additional hardship. Georgia law provides specific rules governing these details about wrongful death claims:

• Who is eligible to bring a claim
• What damages can be pursued
• If pain and suffering is an option

The circumstances surrounding the death also determine which legal claims apply to your claim. A wrongful death case can require an investigation into the accident, medical treatment, employment history, financial contributions, and other evidence relevant to your losses.

Our personal injury law firm in Lithonia can investigate the circumstances surrounding a death and help eligible family members understand their rights under Georgia law.

The Process of Filing a Personal Injury Lawsuit in DeKalb County

If an injury claim cannot be resolved through negotiations, litigation could be necessary. The DeKalb County Superior Court is a local filing venue for qualifying civil matters. The court is part of the DeKalb Judicial Circuit. Located at 556 N. McDonough Street in Decatur, it handles civil cases within its jurisdiction. Filing a lawsuit involves specific procedural requirements like:

• Preparing and serving pleadings
• Participating in discovery
• Responding to motions
• Communicating with opposing counsel
• Preparing evidence for a potential trial

Personal injury lawsuits can be resolved through settlement negotiations or alternative dispute resolution rather than a trial. If a case does go to trial, an attorney can handle the litigation process and explain what to expect at each stage.

The DeKalb County Superior Court itself provides an Alternative Dispute Resolution program, and its court materials note that litigation remains an option when parties use another dispute resolution process.

Lithonia Personal Injury Frequently Asked Questions

An injury can create immediate questions about medical care, insurance coverage, lost income, and financial recovery. The answers depend on the circumstances of the incident, the parties involved, and the laws that apply to your case.

How Long Do I Have to File a Personal Injury Claim in DeKalb County?

Georgia generally provides a two-year statute of limitations for personal injury actions under O.C.G.A. § 9-3-33. However, certain claims have different deadlines, including some workers’ compensation, medical malpractice, wrongful death, and governmental liability claims.

The applicable deadline depends on the type of claim and the circumstances involved.

What Types of Cases Does John Foy Handle in Lithonia?

John Foy & Associates handles personal injury matters involving car accidents, truck accidents, workers’ compensation, slip and fall injuries, wrongful death, defective products, medical malpractice, prescription errors, assault-related injuries, and other injury claims.

The facts of an individual case determine which legal claims and forms of compensation could apply.

How Much Does a Personal Injury Lawyer Cost?

Many personal injury law firms in Lithonia work on a contingency-fee basis. In many instances, a contingency fee often falls between 33.3% and 40%, with roughly one-third of cases operating on a common arrangement.

The specific percentage and terms of your contingency agreement will be established by you and your legal team before you start working with your attorney. Under this type of arrangement, you won’t have to pay an hourly legal fee while your case unfolds.

The attorney’s fee is tied to the compensation your attorney recovers for you. It is also governed by the agreement you sign with the firm. Many attorneys also offer free consultations. That way, you can discuss the circumstances of your claim before deciding whether to retain the firm.

Georgia’s Approach to Negligence and Fault

Many personal injury cases in Georgia are based on negligence. In general terms, negligence involves a failure to exercise the level of care required under the circumstances, resulting in harm to another person.

That doesn’t mean an injured person automatically receives compensation whenever someone else makes a mistake. The evidence needs to connect the other party’s conduct to the injury and resulting damages. Georgia also uses an apportionment system for fault.

Under O.C.G.A. § 51-12-33, a plaintiff who is less than 50% responsible can recover damages, but the award is reduced according to the plaintiff’s percentage of fault. A plaintiff found 50% or more responsible cannot recover damages.

How Comparative Fault Can Affect Your Recovery

In personal injury cases, Georgia doesn’t require a plaintiff to be completely free of fault in order to recover compensation. Instead, the law allows fault to be apportioned among parties. For example, suppose a jury finds that another driver caused a crash.

However, they also determine that the injured driver was 20% responsible. In that instance, an injured person’s damages will likely be reduced by that percentage. Then, if you’re 50% or more responsible, the outcome will be much different.

This is because state laws bar recovery when the plaintiff’s share of fault reaches that threshold. Insurance companies understand how important fault can be, but your attorney can review the evidence and challenge allegations that improperly place responsibility on the injured person.
