Should You Sue Lyft for the Accident You Were Involved In?
There are often many factors that play a role in determining the liability and your legal options after a Lyft accident. However, in many cases, you may file a suit against Lyft for an accident one of their drivers caused. The company is required by law to provide liability insurance that covers victims of accidents their rides cause.
Where the liability is clear and the case clear-cut, you may not even need to file a lawsuit to recover compensation. For instance, if you were a passenger in a Lyft rideshare during the accident, we may be able to argue for fair liability coverage. In Georgia, Lyft is required to pay up to $1 million for accident victims injured while using their service.
There is a big difference between an accident with an ordinary driver and an accident with a ridesharing driver in Georgia. Under the Georgia Law Code Title 33 (Insurance §33-1-24), Lyft’s insurance is liable for damages up to $50,000 per person or $100,00 per accident when their driver causes an accident without a passenger but with their ridesharing app turned on. As simple as they may sound, the guidelines for seeking compensation are rarely straightforward.
Who Can Be Held Liable in a Lyft Accident?
There are two ways you can claim compensation as a Lyft accident victim on Hampton’s roads:
- You can pursue compensation from the driver’s personal insurance company.
- You can claim compensation directly from Lyft.
The key to successfully pursuing compensation after an accident involving a Lyft driver is knowing who to sue. The circumstances of the accident will largely determine who is liable for which costs in the accident. A good Lyft accident attorney in Hampton should carry out a thorough investigation to establish how the accident happened, who was involved, and how you were affected before advising on whom to sue for compensation.
In some cases, you can sue both the ridesharing company as well as the driver at fault for damages. Note, however, that such a case can get very complicated and needs an experienced law firm such as John Foy & Associates to navigate all the complexities and ensure a win.

Compensation After a Lyft Accident in Hampton
As an accident victim, you deserve compensation for all the damages you may have suffered as a consequence of the Lyft driver’s negligence. Depending on the results of our investigation, we may advise you to seek damages for:
- Medical bills already incurred
- Future medical bills
- Damage to your property such as your vehicle or bicycle
- Lost income
- Loss of earning capacity
- Emotional distress
- Pain and suffering
- Scars and disfigurement
- Punitive damages
Finding an experienced lawyer is key to ensuring that you are fairly compensated for all the damages and lost opportunities that are a direct or indirect result of a road accident. If an accident prevented you from working or caused permanent physical injury or disfigurement, you deserve just compensation from the insurance company. If you lost someone you care about in a Lyft accident, you can sue the company or the driver’s insurance for wrongful death.
