Never Settle for Less from the Insurance Company
Stonecrest follows Georgia’s rules on modified comparative negligence. For most accidents, such as Lyft accidents, you need to establish that you were less than 50% responsible for what happened. Even if you weren’t the driver in this instance, the rules still apply. This is why it’s essential that you do two things:
- Figure out who was the at-fault party responsible for the accident.
- Hire a personal injury attorney that can assist you in your pursuit of financial compensation.
Remember, even though the law entitles you with the right to file a claim, that doesn’t mean winning financial compensation will come easily. You still have to fight and negotiate for it. The insurance company may try to offer you a fast settlement, but never accept it. Always push forward towards a fair settlement that covers all your damages.
Figuring Out the At-Fault Party for Your Lyft Accident
The reason why you finding out who to file a claim against is important is because you don’t want to put all this legal work only to find out that the person you built your case against is innocent. Since time isn’t on your side, it’s best to figure out who caused your accident as soon as possible.
The Lyft Driver
The most obvious culprit of a Lyft accident would be the Lyft driver. If they failed to drive in a safe and responsible way, this makes them negligent in their actions. Thus, if their negligence causes an accident, you can file a claim against them and their insurance company. Don’t ever let an irresponsible Lyft driver get away with the accident they made you suffer.
Lyft
Lyft itself can also get held accountable for your damages if they were involved in your accident. While Lyft, being an entity, can’t be directly involved in your accident, there are some ways they can be responsible. For example, if they had bad hiring practices.
Lyft is supposed to hire only qualified drivers to work for their service. If they fail to uphold a strong hiring standard and this lets in an unqualified driver who caused your accident, this would put Lyft to blame for your accident as well.
Another Driver
All drivers on the road need to exercise a duty of care for others. Car accidents happen all the time and if another driver causes your Lyft accident, you can still file a claim against them even if you weren’t the driver of the car. This is because you still sustained damages and injuries, which means you can hold them responsible.
