When Must Drivers Stop for Pedestrians in Georgia?
Georgia’s pedestrian right-of-way rules depend on where you were crossing and whether traffic signals controlled the intersection. Different duties apply in crosswalks, outside crosswalks, and at signal-controlled intersections.
We review the collision location, crosswalk markings, traffic signals, driver speed, visibility, and whether the driver had enough time to respond. That evidence helps us determine how Georgia law applies and challenge unsupported efforts to blame you.
Pedestrians in Marked and Unmarked Crosswalks
Georgia drivers must stop and remain stopped when a pedestrian in a crosswalk is on the driver’s half of the road or approaching within one lane of it. Crosswalks may exist at intersections without painted lines.
A driver cannot pass a vehicle stopped at a crosswalk for a pedestrian. Violating these rules may provide evidence of negligence.
Pedestrians Crossing Outside a Crosswalk
Outside a marked or unmarked crosswalk, a pedestrian generally must yield to vehicles unless they already entered the road under safe conditions. Between adjacent signal-controlled intersections, pedestrians must use a marked crosswalk.
Crossing elsewhere does not automatically defeat your claim. Drivers still must use due care to avoid a collision. Our Albany pedestrian accident attorneys evaluate both people’s conduct before reaching a conclusion about fault.
Georgia’s Comparative-Fault Rule
You can recover damages when you are less than 50% responsible, but your award is reduced by your share of fault. If you are 50% or more responsible, Georgia law prevents recovery. We challenge unsupported allegations that you crossed suddenly, ignored a signal, or could not be seen.
Injuries Caused by Pedestrian Collisions
Some injuries appear immediately, while symptoms of a concussion, internal injury, or spinal condition may develop later.
Pedestrian injuries may include:
- Traumatic brain injuries and concussions.
- Spinal cord, neck, and back injuries.
- Broken hips, legs, arms, or ribs.
- Internal bleeding and organ damage.
- Severe cuts, scarring, and road rash.
- Nerve damage or loss of mobility.
- Emotional trauma following the collision.
Get medical care as soon as possible and follow the treatment plan you are given. Medical records can connect your diagnosis to the crash and document the care you may need in the future.
Who May Owe Compensation After a Pedestrian Crash?
The driver is often the primary defendant, but we look beyond the person behind the wheel when the facts support doing so.
Employers and Commercial Operators
An employer may share responsibility when an employee causes a crash while carrying out job duties. Commercial businesses may also hold route, schedule, training, or vehicle records.
Property Owners and Product Manufacturers
A property owner or contractor may be responsible for an unsafe entrance or blocked sightline. A manufacturer may face liability for a defective vehicle component.
Government Agencies
A claim involving a broken traffic signal, unsafe public road, or government vehicle may be subject to immunity rules and early written-notice requirements. The proper defendant and deadline depend on whether a city, county, or state agency is involved.

Distance is no obstacle. We work with clients across the country and make sure every one of them feels taken care of, no matter how far the call travels.
What Damages Can You Seek in a Pedestrian Injury Claim?
We calculate damages from the evidence rather than relying on an insurer’s estimate. A claim may include compensation for:
- Emergency treatment, hospital care, and surgery.
- Future medical care and rehabilitation.
- Lost income and reduced earning capacity.
- Pain, emotional suffering, and loss of enjoyment of life.
- Mobility equipment, home assistance, and related expenses.
- Other financial and personal losses caused by the collision.
After a fatal collision, eligible family members and the estate representative may have separate claims under Georgia wrongful death law.
What Should You Do After Being Hit by a Vehicle?
If your condition allows, these steps can protect your health and the evidence:
- Call 911 and request medical assistance.
- Obtain the driver’s name, insurance details, and license plate number.
- Photograph the road, crosswalk, signals, vehicle, and your injuries.
- Ask witnesses for their names and contact information.
- Keep damaged clothing, shoes, and personal items.
- Save medical bills, wage records, receipts, and insurer correspondence.
- Avoid a recorded insurance statement before getting legal advice.
Do not delay care because an injury seems minor. An insurer may use a treatment gap against you.
How Insurance Companies Dispute Pedestrian Claims
An adjuster may claim that you were outside a crosswalk, distracted, or walking against a signal. The insurer may also offer a settlement before your prognosis is clear.
We collect objective proof before negotiating, including available video, vehicle data, phone records, witness accounts, police photographs, and medical testimony. Our Albany pedestrian accident lawyers can use this evidence to counter inaccurate fault arguments and low offers.
How Long Do You Have to File an Albany Pedestrian Accident Lawsuit?
Georgia generally allows two years from the injury date to file a personal injury lawsuit. Filing late can result in dismissal.
Government claims can have shorter notice periods. A city claim may require written notice within six months, while county and state claims follow different rules. Contacting our legal team early gives us time to identify the deadline and preserve evidence.
How Our Albany Pedestrian Accident Lawyers Handle Your Case
We handle the legal work and keep you informed. Our team can:
- Investigate the collision and secure available evidence.
- Identify every person, business, or agency that may be liable.
