Dealing With Insurance After a Pedestrian Accident
Expect a quick call from the adjuster asking for a statement or a medical release. You are not required to give a recorded statement to the at-fault insurer, and broad medical authorizations can expose unrelated history. We communicate for you and control the flow of information.
Low opening offers are common, especially before your course of treatment is clear. A fair evaluation accounts for future care, permanent impairment, lost earning capacity, and long-term pain. We prepare a demand backed by records and clear evidence to help prove liability.
Having a lawyer involved also signals to the insurance company that your claim is being taken seriously. With an experienced legal representative working on your behalf, you are in a stronger position to pursue fair compensation.
Time Limits and Filing Deadlines in Georgia
Most pedestrian injury claims must be filed within two years of the incident under O.C.G.A. § 9-3-33. However, claims involving a city, county, or the State of Georgia may require ante litem notices within months, not years. Missing these deadlines can bar you from recovering the compensation you deserve.
Evidence also fades quickly. Video is often overwritten within days or weeks, and witnesses become harder to locate over time. Early legal steps help preserve critical proof and set the stage for a strong claim.
Damages You Can Recover After a Pedestrian Accident
A pedestrian accident can cause both financial losses and serious personal hardships. Georgia law allows injured pedestrians to seek compensation for the full impact of the accident, including costs you’ve already faced and losses that may continue into the future.
Economic Damages
These damages cover the direct financial impact of the crash, such as:
- Medical treatment and rehabilitation
- Lost wages while you recover
- Reduced earning capacity if injuries affect your ability to work
- Transportation costs, assistive devices, or other out-of-pocket expenses
Non-Economic Damages
Pedestrian crashes often involve life-altering injuries that affect one’s quality of life. Compensation for this may include:
- Pain and suffering
- Loss of enjoyment of life
- Scarring, disfigurement, or permanent disability
Wrongful Death Damages
If a loved one was killed in a pedestrian accident, surviving family members may pursue a wrongful death claim. This can include compensation for the full value of the person’s life as well as related expenses such as medical bills and funeral costs, which may be handled through the estate.

Your Rights as a Pedestrian Under Georgia Law
Georgia law requires drivers to yield to pedestrians in marked crosswalks and when pedestrians are lawfully within the roadway. When a driver violates these duties and causes harm, you can pursue damages for economic and non-economic losses.
Under Georgia’s modified comparative negligence rule (O.C.G.A. § 51-12-33), your recovery is reduced by your percentage of fault, and you cannot recover if you are 50% or more at fault. Insurers sometimes overstate pedestrian fault. This is another reason why having an experienced lawyer is critical.
At John Foy, we push back with evidence and analysis when insurers try to shift blame.
What To Do After a Pedestrian Accident
You can protect your health and safeguard your claim by taking the appropriate steps after a pedestrian accident. Some of the most important first steps include:
- Gather information at the scene if you can safely do so, including driver’s license and insurance, witness names, and photos of vehicles, any visible injuries, and the surrounding area.
- Seek medical care. Adrenaline can hide injuries such as concussions, internal bleeding, or fractures, so it’s important to see a doctor even if you feel okay.
- Request the police report or report number for your records.
- Avoid giving a recorded statement to the insurer until you’ve spoken with a Panthersville pedestrian accident attorney. Early statements can be misused to limit your claim.
How John Foy & Associates Builds a Strong Claim
We start with a thorough case intake and a targeted evidence plan. That often includes obtaining 911 calls, canvassing for video, and sending preservation letters to businesses and homeowners who may have footage.
We will also work with medical providers and other parties to get diagnoses, treatment plans, impairment ratings, and estimate potential life-care costs.
Your lawyer will coordinate your claim from start to finish, investigating fault, gathering medical proof, calculating damages, and negotiating with insurers. If the carrier will not agree to a fair settlement, we are prepared to file suit and litigate in court.
Is It Better to Settle or Go to Trial?
Most cases resolve in settlement once liability and damages are clear. A pedestrian accident lawyer will evaluate each offer against likely jury outcomes, then advise you on the best path.
Your lawyer will explain the risks and benefits of each option so you can decide whether accepting a settlement or proceeding to trial better serves your interests. If trial is the right choice, your lawyer will prepare thoroughly: motions, exhibits, witness prep, and demonstrative evidence that explains how the collision happened and what it took from you.
Cost, Contingency Fees, and What To Expect
With John Foy & Associates, you pay no upfront fees. Our fee is contingent on recovery, and we explain costs in writing before you sign. If there is no recovery, you owe no fee. It’s that simple.
Your initial consultation is also free, so there is no financial risk in contacting us to learn your legal options. If you have a viable case, we will handle the paperwork, deadlines, and negotiations while you focus on medical care and rebuilding your routine.
