Common Causes of Pedestrian Accidents
Pedestrian collisions often result from driver distraction, failure to yield, speeding, or impaired driving. Poorly marked crosswalks, low visibility, and drivers making illegal turns also raise the risk of harm.
Many incidents involve passenger vehicles, delivery trucks, or motorcycles. Pedestrian accidents can also happen near busy intersections, parking lots, and at night when lighting is inadequate. Some of the most common causes include:
- Driver distraction from phones or infotainment systems
- Drivers failing to yield at crosswalks or intersections
- Speeding through residential or school zones
- Impaired driving because of alcohol or drugs
Georgia Statute of Limitations for Pedestrian Accidents in Marietta
In Georgia, most personal injury claims, including pedestrian accident cases, must be filed within two years from the date of the injury. This legal deadline is known as the statute of limitations.
If this time limit passes before a lawsuit is filed, you may permanently lose the right to recover compensation, no matter how clear the fault or how serious the injuries are. Evidence can also become harder to obtain over time, as surveillance footage may be erased and witness memories may fade.
For this reason, it is important to act quickly after an accident in Marietta, so your claim can be properly investigated, documented, and filed within the required timeframe.
How Our Pedestrian Accident Attorneys in Marietta Help Injury Victims
We represent people who have been hurt while walking and pursue fair compensation for medical treatment, lost income, and pain and suffering. Our role includes investigating the crash, gathering medical records, and communicating with insurers on your behalf.
You should expect us to explain the applicable Georgia laws that affect your claim and to present options for resolving liability and damages. We work with medical providers, accident reconstruction professionals, and vocational specialists when needed to support your case.
Gathering Evidence and Witness Statements
Collecting clear documentation early strengthens a claim. We obtain police reports, photos, surveillance footage, and witness statements to establish how the incident occurred and who was at fault.
We coordinate with experts to recreate the collision when liability is disputed and to quantify future care needs and earning losses.

Distance is no obstacle. We work with clients across the country and make sure every one of them feels taken care of, no matter how far the call travels.
Steps to Take After Being Hit by a Vehicle
Your immediate actions can affect your legal rights and recovery. Seek medical attention right away, even if injuries seem minor, because some conditions worsen over time.
If you are able, gather basic details at the scene, including the vehicle’s license plate, driver’s name and insurance, and contact information for witnesses. Preserve any clothing or shoes involved and keep a record of symptoms, treatments, and missed work.
Immediate steps to take include:
- Call 911 so emergency responders can create an official report
- Get a medical evaluation and follow treatment plans
- Take photos of the scene, your injuries, and vehicle damage
- Exchange information with the driver and witnesses
Types of Compensation You Can Seek
You may recover damages for past and future medical expenses, lost wages, and reduced earning capacity when injuries affect your ability to work. Non-economic losses like pain, suffering, and diminished quality of life are also part of many claims.
When a negligent driver’s conduct was especially reckless, punitive damages may be available under Georgia law. Claims against local governments for poor road design or signaling require special procedures and strict filing deadlines.
What to Expect From the Claim Process
After you retain our services, we open a case file, request medical records, and send a demand to the insurer for the at-fault driver. Insurers often make early settlement offers that do not fully reflect long-term needs, and we evaluate any proposal against projected damages.
If negotiations do not produce fair compensation, we prepare to file a lawsuit and move through discovery, depositions, and, if necessary, trial. Throughout the process, we keep you informed about timelines and strategic choices.
We aim to secure a resolution that reflects your losses while limiting stress and administrative burdens on you.
Insurance Issues Specific to Pedestrian Claims
Pedestrian claims often involve complicated insurance questions, including whether the at-fault driver has adequate coverage or whether uninsured or underinsured motorist protection applies. Georgia’s comparative fault rules can reduce your recovery if you share responsibility.
We review policy limits, available UM/UIM coverage, and any commercial or fleet policies that may increase available compensation. Timely notice to insurers and accurate documentation of damages are important to preserve recovery options.
Preparing for a Medical and Legal Timeline
Recovery after a pedestrian injury can take weeks to years, depending on the severity. We track your medical progress and update damage estimates as your prognosis becomes clearer. That helps avoid settling before future needs are known.
Expect regular correspondence about case developments and clear explanations of settlement offers as they arise.
