When Pedestrians Can Claim Compensation After an Accident
When a negligent driver strikes a pedestrian, and your lawyer can show that the accident happened because they failed in their duty of care, you may be able to claim compensation. For example, if a driver fails to yield at a crosswalk, is speeding, or is driving unsafely and causes an accident involving a pedestrian, they may be found liable.
Under Georgia’s modified comparative negligence system, you can still claim compensation as long as you were 49% or less at fault. If you have some share of the fault, your compensation is reduced by that proportion of liability. For example, if you are 30% to blame for your pedestrian accident, you can still claim 70% of your damages.
Insurance companies may try to build a case that reduces your compensation. If they can establish that you were 50% to blame, you may not qualify for any compensation. Your lawyer will work to build a strong case and hold at-fault parties accountable.
Types of Damages a Lawrenceville Pedestrian Accident Lawyer Can Seek On Your Behalf
Many people wonder how much they can claim after a pedestrian accident. The answer depends on the specific damages you suffered. Your lawyer can calculate the value of the damages you can hope to recover.
They may include:
- Medical costs and future medical expenses related to your injuries
- Lost wages or earnings and future losses
- Compensation for disability or disfigurement
- Pain and suffering
- Trauma and emotional distress
- Loss of the ability to enjoy life as you did before
To get the full picture of what damages you may be entitled to recover, your attorney will talk to medical experts, consider your future outlook, and use accepted methods to accurately value your losses.

Key Steps to Take if You or Someone Close to You Has Been Injured in a Pedestrian Accident
You have probably taken the first and most important step by seeking medical attention. Follow your medical team’s instructions carefully and talk to them if you notice new symptoms. Your recovery to health and your right to compensation may depend on it.
Your next step is to get a lawyer to build a case for you and to represent you in dealings with insurance companies. Ideally, it may be in your best interest not to talk to them without a lawyer’s advice.
Gather all the accident-related evidence you have and find out how our Lawrenceville pedestrian accident attorney can help protect the integrity of your claim.
Discussing your accident or injuries on social media may unintentionally hurt your claim. If the insurance company contacts you, you have the right to refer them to your lawyer.
Although their representatives may sound concerned and helpful, saying simple statements like “I’m fine” might unintentionally jeopardize your claim.
Pedestrian Accident Fatalities and Wrongful Death Claims
Pedestrian accidents can have tragic results. The National Highway Traffic Safety Association’s 2023 ranking of state pedestrian fatalities shows that Georgia ranks 9th. This unfortunate fact means that many families are left to mourn the loss of loved ones after avoidable pedestrian accidents.
While we know compensation cannot make up for losing a loved one, we hope holding the negligent party accountable can help surviving family members find some sense of closure. Financial compensation can help ease any unforeseen financial burdens, including burial and funeral expenses.
