Riverdale Drunk Driving Accident Lawyer

No one wants to need to hire a drunk driving accident lawyer in Riverdale. However, an individual may need to do so following a drunk driving accident that causes serious injuries. There are several reasons why.

A Riverdale drunk driving accident attorney can help a victim seek damages. The attorney learns about the victim’s medical bills and other costs relating to the accident. Next, the lawyer works with their clients to sue the at-fault party.

You Can Recover Multiple Types of Damages in a Riverdale Drunk Driving Case

Drunk driving accident victims may qualify for any of the following types of damages:

• Special: These damages are quantifiable. They relate to the loss of income, medical bills, and other expenses incurred due to an accident.
• General: A victim can pursue general damages due to pain, suffering, or other emotional trauma relating to their accident.
• Punitive: A victim can be awarded punitive damages by a judge or jury. These damages are considered a form of punishment and deter an at-fault party from negligent acts in the future.

It pays to partner with a Riverdale drunk driving accident attorney who knows the ins and outs of Georgia personal injury laws. This attorney can review their client’s legal claim. The lawyer can file a lawsuit to help their client get the maximum amount of damages from an at-fault party.

There Is a Two-Year Window to Pursue Damages Following a Drunk Driving Accident

Do not wait to seek damages after a drunk driving accident in Riverdale. Georgia law states there is a two-year time frame for accident victims to pursue damages. Those who wait more than two years miss their opportunity to sue anyone responsible for their injuries.

Following a drunk driving accident, consult with a doctor. This allows an accident victim to receive medical care and support. The victim should collect medical bills and track them moving forward.

In addition, a drunk driving accident victim should monitor any loss of wages or other financial issues that crop up due to their injuries. The victim should keep a record of any invoices that relate to their drunk driving accident as well. This individual can then present all associated financial records to a drunk driving accident attorney in Riverdale for review.

An At-Fault Party Must Be Held Responsible for a Drunk Driving Accident

In its most recent annual research, the Foundation for Advancing Alcohol Responsibility reported 353 fatal alcohol-impaired driving fatalities in Georgia. These fatalities may have been prevented if the driver involved acted responsibly. Yet, the driver’s negligence between the wheel has had serious ramifications on victims and their families.

It is impossible to change the result of a drunk driving accident. Conversely, a victim can ensure the driver responsible for the accident is held accountable for their negligence. To do so, the victim can file a personal lawsuit against the at-fault party.

There is no guarantee that a drunk driving accident victim will be awarded damages. Regardless, filing a lawsuit can help illustrate the impact of drunk driving. The lawsuit can deter the individual responsible for the accident from driving drunk again and may do the same for others.

It Takes Time to Prepare for a Drunk Driving Accident Court Date

Once a drunk driving accident victim files a lawsuit, it may take months or years before the case goes to court. In the meantime, the victim’s attorney provides ongoing support. The attorney helps the victim gather evidence and get ready for their court date.

There is a wide range of evidence that can support a drunk driving accident victim’s claim. The victim can provide copies of medical bills and other expenses associated with their accident. It can also be beneficial to collect testimony from accident witnesses.

Along with retrieving evidence, a drunk driving accident attorney helps their client prepare for questions. An accident victim will face questions from both their lawyer and the at-fault party’s attorney. The victim can plan ahead for such questions and feel comfortable and confident when their court date arrives.

Some Drunk Driving Accidents Are Settled Out of Court

There can be instances in which a drunk driving accident lawsuit is settled between the victim and the at-fault party. At these times, the at-fault party may present a settlement offer to the victim. Then, the victim can review the offer with their attorney.

A settlement offer may seem too good to be true at first glance. Fortunately, a drunk driving accident victim and their attorney can assess the offer in depth. This allows the victim to understand the pros and cons of accepting or rejecting the offer.

If the victim declines a settlement offer, there is no need to panic. The victim and at-fault party can continue to negotiate a settlement proposal before a court date. If no settlement is reached, a judge or jury will hear the case and decide if the victim will be awarded damages.
