Why You Need Compensation for Damages Suffered
The damages caused by a motorcycle accident can be life-changing. A fair settlement can help you work through those changes and bring some level of restoration.
Medical Needs
If you didn’t cause your injury, you should not have to pay the medical expenses for your rehabilitation. Medical expenses are not just for your physical needs, but for the emotional trauma caused by the accident and the stress of your injuries.
Property
Your motorcycle was likely damaged in the accident. Your compensation can pay to repair or replace your motorcycle. You may need to make structural changes to your home to accommodate your changed abilities.
Financial Security
If you lost wages because of missed work, have to change your line of work, or cannot work anymore, you need to recover those lost wages, both past and present, to ensure your financial security.
Death Benefits
Sadly, motorcycle fatalities in Georgia have increased in recent years. If you are seeking compensation for a loved one killed in an accident or as a result of the ensuing injuries, you may be entitled to recover end-of-life expenses and other benefits.
How Georgia Comparative Negligence Laws Can Affect Your Compensation
When you have a motorcycle accident in Riverdale, the amount of your compensation is affected by Georgia’s modified comparative negligence statute. If you are found to be more than 49% responsible for the accident, you do not receive compensation.
If you are determined to be less than 49% responsible but still found to hold some fault, the total compensation you would have received is reduced by the percentage of your fault. In other words, if you are found 15% responsible, your total compensation is reduced by 15%. For your negligence claim to be established under Georgia law, you have to prove four elements:
- Duty of Care: The defendant owes you a level of care. For example, drivers have a duty to other drivers to drive safely.
- Breach of Duty: The defendant failed to provide their duty of care. For example, the other driver was texting and driving at the time of the accident.
- Causation: The defendant is responsible for damages because of the breach of duty.
- Damages: The plaintiff’s life has been significantly affected by the damages, whether physically, financially, emotionally, etc. (or in all of those areas).
These elements are not always easy to prove, especially if you are up against serious opposition. Trust your Riverdale motorcycle accident lawyer to investigate the causes of your accident thoroughly and represent your interests as the injured party.
