Being involved in a car crash is stressful, but it can also be devastating and confusing when the collision involves a ridesharing vehicle. In addition, you might suffer serious injuries that leave you with pain and discomfort, including significant financial injuries. Luckily, Georgia law allows anyone injured in Uber, Lyft, or any ridesharing vehicle caused by a negligent driver to seek compensation and recover damages.

Understanding Your Legal Rights to Insurance Compensation After an Uber Accident
If you are hurt in an Uber accident caused by someone else, you might be eligible to seek compensation under Georgia law. However, it is essential to know your rights to insurance compensation since Uber is unlikely to provide coverage if a careless driver caused the accident. This can make the case more complicated, hence the need for a Gainesville Uber accident lawyer.
Typically, insurance coverage depends on the status of the vehicle during the time of the collision:
- The Uber vehicle would have one million dollars in commercial liability coverage and another one million dollars in uninsured motorist coverage if the driver carried a passenger or was en route to pick up a passenger.
- Suppose the driver had no rider but was online or on duty. In that case, the vehicle carries a $50,000 coverage for bodily injury, $100,000 for multiple physical injuries in a single crash, and $30,000 for property damage.
- Since Uber drivers use their vehicles, accidents that occur when they are offline or not on duty imply that the driver’s car insurance policy covers any losses incurred in a crash.
Steps to Take After a Gainesville Uber Accident
Most people get confused about what to do after an Uber accident involving a negligent, careless, or reckless driver. If you were involved in an Uber collision in Gainesville, follow the below steps to defend your legal rights and boost your chances of obtaining compensation.
Seek Medical Attention
Consult your doctor to determine the extent of your injuries and prepare a medical record. Besides, ensure you keep all medical records, including diagnosis, medication, treatment, and follow-up procedures.
Contact the Police
It is essential to call 911 after an Uber accident to file a crash report and access emergency services, especially when you suffer serious injuries.
Gather Information within the App
Since Uber and other rideshare services operate using a mobile app, collecting any relevant information associated with your ride is crucial. These include the Uber driver’s name, driver’s reviews, and the time and location of the collision.
Collect Information from the Scene
Take pictures of the scene, mainly damages to the vehicles and your injuries. Gather information from witnesses, such as their names, contact information, and details about the crash.
Hire an Experienced Gainesville Uber Accident Lawyer
Contacting an experienced Uber accident lawyer can help you with the claims process. In addition, a Gainesville personal injury lawyer can help build a strong case against the at-fault party and recover maximum compensation on your behalf.
Determining Liability in a Gainesville Uber Accident
Although Uber provides insurance coverage in case of a collision, victims must first file a claim to hold the liable party accountable. Besides, the Uber driver’s status during the time of the accident establishes coverage options you might qualify to pursue. Proving various aspects can be difficult since several parties, including the Uber driver, Uber, and their insurance companies, are involved.
Working with a Gainesville Uber accident lawyer at John Foy can help present the necessary evidence to prove the liable party. In addition, it helps determine who to pursue and recover benefits from to cover all your damages.

Filing an Uber Accident Claim in Gainesville
Typically, the Georgia statute of limitations gives victims of Uber accident claims two years to file their lawsuit and recover losses from the at-fault party. While the deadline may seem long, some people may delay filing their claim and risk missing the time limit, especially when lacking critical documentation to file a legitimate claim. Besides, the legal process of filing an Uber accident suit can be time-consuming and confusing, and this might make the process long and intricate.
An Uber accident lawyer in Gainesville understands the process and documentation required to file a winning claim against a negligent Uber driver. Working with a lawyer can help ensure you file your claim correctly and on time, helping you avoid missing the deadline. This can help increase your chances of pursuing fair compensation from the at-fault party.
Recoverable Damages in an Uber Accident Claim in Gainesville
If you were injured in an Uber accident caused by a negligent Uber driver, you might be entitled to economic and non-economic damages. These include:
- Past, present, and future medical expenses
- Lost wages, employment benefits, and income

- Pain and suffering
- Emotional distress
- Property damage

Wrongful death benefits could be awarded to the victim’s family if the Uber accident led to serious injuries, resulting in their death.
