Gainesville Rideshare Accident Lawyer

Gainesville residents and visors alike rely heavily on the available rideshare options, which can make it easier for them to get around the area. Heading to or from the airport, getting a ride while out on the town, or just getting a ride to an unfamiliar area becomes much easier with rideshare drivers available.

Gainesville Uber and Lyft drivers, however, do not necessarily have any greater skill than the average driver, and they can still cause dangerous accidents that result in substantial injuries. Carefully navigating Gainesville personal injury lawyer claims can increase the odds that, when a rideshare driver does cause an accident, you can recover the compensation you deserve. A Gainesville rideshare accident lawyer can help you learn more about your right to compensation following an Uber or Lyft accident.

Who Bears Liability in Uber and Lyft Claims in Gainesville?

In order to determine who you need to file a claim against following a Gainesville rideshare accident, you must start by determining liability for the accident. Both Uber and Lyft offer substantial insurance policies that cover their drivers when they cause an accident. Due to the high value of those policies, they can often provide substantial compensation for drivers who may have sustained severe injuries due to the negligence of a rideshare driver.

However, that does not necessarily mean that the rideshare driver will automatically bear liability for an accident. As a passenger in a rideshare vehicle, you may know that you did not cause the accident, nor will you have to pay for damages caused by the accident, but you may still need to determine who actually caused the accident in order to file an injury claim.

If the other driver involved in an accident caused it, or caused the majority of the accident, you may need to pursue compensation through that driver’s insurance company, rather than through Uber or Lyft.

Recovering Compensation Following a Gainesville Rideshare Accident

For many people, knowing how much compensation they can expect to recover following a Gainesville rideshare accident can prove critical. Often, you may rely on that compensation to help take care of your goring bills after an accident.

Settlement calculations may look different depending on who caused the accident and the extent of the damages you faced. However, most Gainesville rideshare accident claims will take into account the same common elements.

What Injuries Did You Suffer?

The injuries you suffered in your rideshare accident can have a substantial impact on how much compensation you can recover, because you will begin with your medical costs as you establish your right to compensation. If you suffered a traumatic brain injury, for example, you may end up with much higher medical bills than someone who sustained whiplash in the accident.

Pull together an evaluation of all your medical bills. If possible, start keeping track of your medical costs immediately after the accident so that you can put together a better estimate of those medical bills for your claim later.

How Much Time did You Miss from Work?

The next element of compensation for your rideshare accident will depend on the wages you lost as a direct result of your accident. Wage loss can put substantial weight on your shoulders, particularly as you watch your bills increase significantly as a direct result of your accident. Talk to a Gainesville rideshare accident attorney about the time you have missed at work, including:

• Lost hours, specifically
• Lost vacation time
• Lost sick time
• Lost time due to follow-up treatments

You may also want to discuss whether your injuries have permanently prevented you from working in your industry, which could entitle you to compensation for your lost earning potential.

What Type of Suffering did You Face?

In addition to direct compensation for financial losses due to your accident, you may also have the right to claim compensation for the general, or non-financial, damages associated with your injuries. Talk to a rideshare accident attorney in Gainesville about the suffering caused by your accident, including your limitations, physical pain, and any emotional anguish caused by the accident and the injuries you suffered.
