What do I Need to Know After Being Injured?
There are several important things you should know about after a personal injury accident.
1. Legal Liability
If your accident was caused by someone else’s negligence, they are legally responsible for the costs you face because of the accident (also known as damages). That means you can file a personal injury claim with the at-fault person’s insurance company for your damages.
2. The Importance of Seeing a Doctor
Don’t blame yourself—and take your injuries seriously. Even if you don’t feel “that bad” or your injuries seem minor, you should still see a doctor as soon as you can after your accident. Many injuries can worsen with time or treatment ends up costing much more than you expect. It’s important to protect your rights by seeing a medical professional. Plus, this is good for your insurance claim because it shows you sought treatment very soon after you were hurt.
3. Don’t Trust the Insurance Company
You should also know that the insurance company is not on your side. They will look for ways to pay you less because they care about their bottom line. That means you should never take the first settlement offer or trust them if they contact you.
If you take an offer, it pretty much eliminates any chance you might have of getting a better settlement. And we can almost guarantee that the first thing the insurer offers you won’t come close to covering all your damages.
4. Experienced Legal Help is Invaluable
To protect your rights, it’s a good idea to contact a trusted Peachtree City personal injury lawyer as soon as possible. Our personal injury law firm, can help you with the most important steps after your accident. That includes negotiating with the insurance company and fully communicating with them on your behalf. Your attorney can also evaluate the strength of your claim, help you investigate the details of your accident, and refer you to medical specialists if necessary.
How do I Know If I Have a Valid Personal Injury Claim?
If you were injured in an accident that wasn’t your fault, you likely have a valid personal injury claim. In Peachtree City and all of Georgia, an injury victim is legally entitled to compensation of all damages resulting from the accident that injured them.
Every person has a certain “duty of care” to act in a manner that doesn’t put others in the way of harm. If they violate this duty, they are considered legally negligent or careless. This doesn’t necessarily mean the person meant to hurt you or cause harm.
In fact, this is the case in most personal injury accidents. But they still acted (or didn’t act) in a way that caused you harm—and that usually means they are liable for damages.
What Are Examples of Negligence That May Result in Personal Injury?
- A driver is texting on their phone and they drift into another driver’s lane, causing a car accident that leaves the second driver with a concussion.
- The owner of a property fails to fix a step they know is broken. They don’t put out a sign or warn anyone about the hazard. A visitor slips and falls on the broken step, breaking their arm.
- A dog owner fails to leash their dog that has demonstrated aggressive behavior in the past. The dog charges at a passerby and bites them.
These are just a few examples. There are many other situations where someone is injured and can make an insurance claim against the at-fault party.
This includes family members filing a claim on behalf of a loved one who was killed in an accident caused by someone else. Certain family members can begin a wrongful death case for damages the deceased suffered or loss because of their death.
If you’re unsure whether your situation qualifies as a personal injury accident, schedule a consultation with a personal injury attorney. A Peachtree City, GA injury attorney can let you know what your options are, including what they think your case is worth and the best way to get the process started. In most cases, you have two years from the date of your accident to file a claim—and that time goes much faster than you’d think.
