How a Catastrophic Injury Claim Works
If a person suffers a catastrophic injury because of another person or company’s inattentiveness, the victim may file a catastrophic injury lawsuit. By taking this step, they are seeking compensation for their losses. A few common losses that catastrophic injury victims experience is lost pay from their jobs, accruing medical bills, increasing amounts of assistance to do daily tasks, and emotional and physical distress.
Catastrophic injury attorneys will work with accountants and medical professionals to determine the financial compensation the victim may need to live a successful life after experiencing this type of injury.

Proving Negligence in a Catastrophic Injury Case
Proving negligence when a person has been seriously injured may seem simple, but it is not an attorney’s easiest duty. These cases involve a lot of time studying the facts and showing proof that certain elements happened. To successfully prove that negligence is the reason for a catastrophic injury case, four different components must be established, which include:
- The person or company responsible owed the victim a duty of care.
- The individual or company breached this specific duty.
- This breach resulted in the victim’s injury or accident.
- And the victim experienced losses due to the person or company’s behavior.
Catastrophic injury cases are still considered personal injuries, so negligence must be a factor. If you can prove someone else’s negligence was the reason for the accident that led to your injuries, you will have a successful case.
