How to Know If You Are Covered By Workers’ Compensation in Peachtree City

Workers’ compensation is a type of insurance that employers purchase to cover employees. If someone gets hurt while at work, they are entitled to medical treatment, medical reimbursement, disability benefits, and sometimes vocational rehabilitation through workers’ compensation benefits.

Chances are very good that you are covered under workers’ compensation in Peachtree City. That’s because any business with three or more regular workers is required to purchase a workers’ compensation policy, according to the Georgia State Board of Workers’ Compensation (SBWC). The SBWC assists with the resolution of workers’ comp claims in Georgia and serves more than a quarter of a million employers and 3.8 million workers.

You are probably covered by workers’ compensation in Georgia. If you are still unsure, you can verify your employer’s coverage through the Georgia State Board of Workers’ Compensation website or by contacting an experienced Peachtree City workers’ compensation lawyer.

Workers Who Are Not Covered By Workers’ Compensation

Although most workers are covered under workers’ compensation, there are some who are not. According to Georgia Code § 34-9-2, those workers not covered typically include:

• Common railroad carriers
• Farm laborers
• Domestic servants
• Any person, firm, or private corporation that has less than three employees
• Licensed real estate salesperson or associate brokers providing services as an independent contractor
• Other independent contractors

Many of the above workers are often covered by other programs that provide similar benefits to workers’ compensation.

There Is No “at Fault” Party in Workers’ Compensation Cases

When you file a personal injury claim after an accident like a car crash, the case depends on who was at fault. This is not the case with workers’ compensation. Workers’ compensation is unique in that it’s a “no-fault” system. You cannot blame or sue your employer for your work accident, and your employer cannot deny you benefits by blaming you.

The no-fault structure of workers’ compensation is meant to:

• Ensure workers get benefits after being injured at work and
• Prevent lengthy and expensive lawsuits between employees and employers

Although workers’ compensation is no-fault, there are still issues workers run into when trying to file a claim. That’s because you’re typically dealing with an insurance company, not your employer directly. Insurance companies do not like to pay much on injury claims, even if they are for workers’ compensation.

To make sure you fully understand what you’re owed and are seeking the best compensation possible, contact a workers’ compensation lawyer in Peachtree City soon after your accident. They can be your legal guide through each step of the process and deal with any trouble from the insurance company.

Most Common Injuries that Happen at Work

Some of the most common work injuries that happen include:

• Slips, trips, and falls

What You Must do to Receive Your Workers’ Compensation Benefits in Peachtree City

No matter what type of injury you suffer, you’ll need to file a claim to actually receive your benefits. Here’s how you can do that.

Report the Accident

Make sure your employer knows about the accident. It’s best to report your work injury to your supervisor immediately after it happens. If you wait more than 30 days to report your accident, you will likely lose your chance at benefits.

Gather Evidence of Your Costs

Before you can file your claim, you’ll need to understand the costs of your injuries. A workers’ compensation lawyer can help you determine how much your costs will be, including medical expenses, missed work time, and whether or not your injuries might leave you with a permanent disability.

File Your Claim

You will need to fill out a Form WC-14 and file it with the SBWC. Then, you’ll need to send a copy of that form to your employer and the insurance company they use to provide workers’ compensation benefits.

Contact a Lawyer

You’ll also want to contact a lawyer as soon as you can, even if it’s just to schedule a consultation and get advice on how your case looks. A workers’ compensation lawyer can be invaluable for your case—and the sooner they can help, the better.
