Recovering from an accident takes time and patience. Waiting for things to get back to normal can be overwhelming. It’s even worse if you know someone else was responsible. After the incident, you might wonder how you can recover your accident injuries and costs.
If someone else caused your accident, you have legal rights. You might have a personal injury case to get compensation for your costs. However, it’s crucial to get started soon and fully understand your options.
How to Recover from Your Accident Injuries
First, your physical well-being is important. Some accident injuries can be severe or life-threatening. Keep yourself well by seeing a doctor as soon as possible.
Getting medical treatment after an accident has two primary purposes:
- Knowing the full extent of your injuries
- Documenting your injuries from the accident
The human body does not have a shortcut to healing. Getting treatment and feeling better takes time. Injuries can also worsen quickly without attention.
Protect your health and legal rights by seeing a medical professional right away. If you wait too long, you could delay your treatment process. Waiting can also hurt your legal options.
Proving Negligence for Your Injuries
If someone’s negligence causes an injury, that person is responsible for the costs. Negligence is the absence of care that regularly careful people would have under a similar situation, according to the Official Code of Georgia Annotated (OCGA) §51-1-2.
You can usually file a personal injury claim with the negligent party’s insurance company. However, the insurance company will use it against you if you wait too long to get treatment. The insurer might say your injuries are not as bad as your claim shows.
A personal injury lawyer can help prove your accident injuries. At John Foy & Associates, we know how to build strong claims and fight for your rights. Call us at (404) 400-4000 or contact us online for a FREE consultation.
Recovering Damages for Your Injuries
If you were not at fault for your accident injuries, you can probably recover damages. Personal injury damages are the costs you face because of your injuries.
Common injury damages include:
- Doctor and hospital bills
- Prescription medications
- Lost wages
- Loss of earning capacity
- Vehicle or property repair costs
- Pain and suffering
You might be able to recover all damages from your injuries. However, the money doesn’t come to you automatically. You’ll need to show that someone was at fault for your injuries.
Your personal injury claim will need to prove the following:
- Someone owed you a duty of care.
- That person or party breached their duty of care.
- The person or party’s negligence caused your accident.
- You have injuries and other damages from the accident.
An experienced lawyer can help you prove each of the above points. If the other person was entirely at fault, they are responsible for your accident injury costs.

Documenting Your Accident Injuries
Personal injury claims can be complicated. You will need to show a direct connection between the at-fault party’s carelessness and your injuries. You can do this by:
- Getting a copy of the accident report
- Taking pictures of the accident scene
- Photographing your injuries and other damages
- Talking to any eyewitnesses to the accident
- Getting medical attention as soon as possible
- Keeping track of your medical bills and other documents
It’s also best to talk to a lawyer as soon as possible. A lawyer can help with all of the above and more.
If it’s possible, wait until you’ve fully healed before filing your claim. You might need long-term treatment. Be sure to include any future medical care costs in your claim.
Ways to Support Your Recovery
You can help your situation by taking care of yourself. After the accident, follow all instructions from your doctor. That includes going to follow-up appointments and calling your doctor if you have new or worse pain.
You can also help your injuries recover by:
- Resting as much as possible
- Limiting physical and mental activity
- Eating well and drinking plenty of water
- Starting a stretching routine if it’s okay with your doctor
- Considering physical therapy
- Talking to a therapist about your emotions after the accident
Not all accident injuries are physical. You might have mental or emotional “injuries” too. Trauma is common for accident survivors, even when damages are minor. Talk to your lawyer about all ways the accident has affected you, including emotionally.
