How the Peachtree City Truck Accident Claims Process Works
The process of recovering compensation after suffering a debilitating injury can be overwhelming. However, when you have a truck accident lawyer in Peachtree City, GA working on your case, you can breathe a sigh of relief.
Understanding how the claims process works can give you the insight you need to feel empowered and confident in your pursuit of justice. Here is a basic idea of how the truck accident claims process might go for your case:
- Your lawyer begins by thoroughly investigating the circumstances of your case.
- We continue investigating and gathering the evidence needed to prove liability and establish negligence.
- Your lawyer will go over all of the ways you have been affected by your truck accident injuries and resulting damages to determine how much we should seek in compensation.
- We will file the necessary insurance claims and begin the negotiation process.
In some cases, we can avoid going to trial by settling with the insurer, but if insurance does not cover your losses entirely, our next step would be to bring your case to court.
Liability in Commercial Truck Accidents
Liability is the most critical element of any truck accident case. For the vast majority of injury victims, one of the only ways to recover compensation is by holding the at-fault party accountable for their negligence.
Causes of Truck Accidents in Peachtree City
To start, we will need to carefully review how your truck accident happened. The roadways in Peachtree City are not always safe. There may have been potholes, defective traffic lights, missing street signs, or unsecured road construction zones that contributed to your accident.
Additional causes include a mechanical failure or defect on the 18-wheeler. For example, there could have been steering problems, issues with the braking system, the truck could have jackknifed, or a massive tire blowout.
Alternatively, many truck accidents are caused by negligent truck drivers. Although truckers should be held to a higher standard due to the massive size of the vehicles they operate, many truck drivers fail to uphold this obligation. If a truck driver is speeding, driving under the influence, distracted driving, driving while fatigued, or operating the 18-wheeler aggressively, they could cause debilitating injuries and death.
Potential At-Fault Parties
The parties who you may be able to sue for your truck accident damages could vary widely, depending on how the accident occurred. For instance, when dangerous road conditions cause your injuries, there are several parties who could share fault, such as:
- The town of Peachtree City
- The Georgia Department of Transportation (GDOT)
- Other municipalities
- Government authorities and agencies
- Safety inspectors
In instances where negligent truck driving causes the accident, not only will you have the chance to sue the truck driver for their negligent actions, but the trucking company that employs them could also share the blame.
Trucking companies are frequently held accountable for the actions of their truck drivers. When they fail to conduct thorough background checks or provide their employees with the job training they need should be held accountable for their negligence when a collision occurs.
How Shared Fault Impacts Your Peachtree City Truck Accident Settlement
You could be accused of sharing liability for your truck accident damages in Peachtree City. It is one of the only opportunities the defendant may have to reduce their own financial liability. Thankfully, when you have a skilled John Foy truck accident attorney in Peachtree City advocating for you, the liable party will not be able to take advantage of you during your greatest time of need.
Georgia follows a modified comparative negligence system. So as long as your portion of the fault does not exceed 50%, you can still recover compensation for your damages. However, you should also expect your injury settlement to be reduced to reflect your percentage of liability.
