Common Scenarios that Lead to Slip and Fall Accidents in Valdosta
Slip and fall accidents can be tricky. We find that victims are often worried to report the accident or seek legal action out of embarrassment. They might assume they were just being clumsy or somehow caused the slip and fall. However, we find that clients are often surprised to learn that someone else was negligent in their accident.
Sometimes, it’s not possible to avoid a slip and fall accident even if you were being careful. Property owners and occupiers in Georgia have a legal duty to keep their premises safe, and failing to do so can mean they’re liable for damages from an injury (Georgia Code § 51-3-1). Those damages may include:
- Medical expenses (including future treatment)
- Lost wages
- Loss of earning capacity and
- Pain and suffering
Here are some examples of how slip and fall accidents commonly happen. Keep in mind that your accident doesn’t have to necessarily mirror these scenarios. If you were slipped, fell, and were injured because the property owner or store was negligent, you are likely entitled to compensation.
Falling on a Wet and Slippery Floor
Some of the most common slip and fall accidents happen due to wet and slippery floors. This might be from employees who are mopping and forget to put out a “wet floor” sign. Or, it could result from spilled beverages or other liquids, rain or melted ice that has been tracked into the store, or some other hazard that can cause visitors to slip.
Those who maintain the property must be careful to watch for hazards and clean them up within a reasonable amount of time. If they don’t someone might slip before they can do anything to prevent it and get terribly injured.
Poorly-Maintained Walkways
Someone can easily trip and fall if parking lots, sidewalks, or other walking areas are not maintained properly. Uneven flooring or surfaces, debris, potholes, cracks, and other dangerous conditions can lead to slips and falls. Even poor lighting can make it hard for customers or visitors to see the floor in front of them and avoid falling.
Property owners must fix hazards when they notice them, and they must be able to recognize them in a reasonable amount of time. Otherwise, it’s negligence that can make them responsible for the costs of a slip and fall accident. This applies to both private and commercial property owners.
Dangerous Weather Conditions
Ice, snow, and rain can all potentially cause hazards on a property. Property owners and businesses must be careful to keep floor conditions safe when weather conditions create slip and fall hazards. That might include drying off floors, putting out mats at entrances, and salting icy walkways to prevent falls.
How to Handle the Moments After a Slip and Fall Accident
The way you handle the aftermath of a slip and fall accident can make a big difference in the outcome of your case. The more evidence you can gather, the better you can show what happened and begin building a strong claim. This will also help your slip and fall and premises lawyer when they work on your case.
Here are some things we recommend you do after you get injured from a slip and fall.
Get Medical Attention
If you have injuries that are very serious or life-threatening, get medical help right away. Injuries can worsen quickly, and your well-being is the top priority. Otherwise, be sure to see a doctor as soon as you can after leaving the scene.
If you can go to your doctor on the same day as your slip and fall accident, that’s ideal. Seeing a doctor will create a record of your injuries and show that you sought treatment right away. This will help prevent the insurance company from trying to say you were not hurt that bad or that the treatment wasn’t relevant to your accident.
Document the Scene
Slip and fall accident scenes can be cleaned up quickly, so it’s best to preserve the scene as best you can. Use your phone to snap photos of:
- The hazardous or dangerous condition that caused your fall
- Your injuries
- The entire accident scene and
- Anything else you think might help your claim
Picture evidence can be very powerful in backing up your insurance claim.
Report the Accident
Make sure the property owner or store manager know that you fell and were injured. They will likely create a report of the accident.
You can also contact a lawyer. Our team can help with:
