When a car strikes a pedestrian, they experience an initial impact followed by one or more additional impacts as they come to rest. Unprotected by safety gear or a vehicle’s safety-engineered body, they are at risk of very serious injuries.
A Sugar Hill personal injury lawyer from John Foy & Associates may help protect them from financial consequences and personal losses after an accident they weren’t to blame for.

Fault in Pedestrian Accidents in Georgia
Fault affects your ability to recover compensation, so it is an important consideration. If you are more than 49% at fault, you cannot recover compensation.
Georgia law applies the modified comparative negligence rule in pedestrian accident cases. When pedestrians share less than 50% of the fault for accidents, their compensation is reduced by their share of fault.
Situations in which a pedestrian shoulders some or all of the blame for an accident include:
- Jaywalking
- Failure to be alert (distraction)
- Impairment due to the use of substances
- Suddenly or unexpectedly entering a roadway
Your Sugar Hill pedestrian accident lawyer will work to show that you were not at fault, or that your share of fault was minimal. They will also be alert to the possibility of unfair blame-shifting, protecting your right to compensation.
Damages Our Pedestrian Accident Attorney in Sugar Hill May Seek on Your Behalf
When a pedestrian is injured in an accident, their damages go beyond the immediate cost of medical treatment. Some injuries can lead to lifelong consequences, and your attorney must also factor in the personal costs of being injured.
Damages your lawyer considers include:
- All medical costs related to your injury, including future costs
- Loss of wages or earnings while you are unable to work, and reduced earning capacity as a result of your injuries
- Disability or disfigurement
- Pain and suffering
- Psychological trauma
- Loss of the ability to enjoy your life and family relationships
Most people injured in an accident experience some or all of the above. Without an attorney’s help, they may struggle to make a case for full compensation. When offered a settlement, they don’t know how to evaluate it, and may settle for far less than they should.

How John Foy & Associates Handles Your Case
We evaluate your pedestrian accident to determine whether you may have a case for compensation. If we believe that you do, we investigate existing evidence and search for additional evidence to support your claim.
Once we understand your damages and future needs, we prepare and present a claim. Insurance companies may raise certain queries and negotiate the settlement. Your Sugar Hill pedestrian accident attorney will know how to handle this phase of the process effectively.
If negotiations end in an acceptable settlement offer, your lawyer will recommend that you accept it. If, on the other hand, it seems likely that you would receive a far better settlement through a court ruling, we will represent you in court.
Your Priorities After Being Injured in a Pedestrian Accident
Although gathering evidence at the accident scene can be helpful, your health and recovery are far more important. In serious accidents, first responders will record details on the scene, and your lawyer can search for further evidence to support your case.
Prioritize medical treatment and follow your doctor’s instructions carefully, being careful to avoid any action that might jeopardize your recovery. Choose a lawyer to work on your case as soon as possible. Even if the full extent of your damages is still unclear, they can begin investigating your accident, gathering evidence to support your case.
Remember that you should never give a recorded statement to an insurance company without having legal representation. If insurance companies approach you with a settlement soon after your accident, it is almost certain that they are offering far less than you can recover. Don’t commit to anything until you have discussed your case with a lawyer.
Common Causes of Pedestrian Accidents in Sugar Hill
In its report on pedestrian safety, the National Highway Traffic Administration (NHTSA) identified the top causes of pedestrian accidents in the USA. These include:
- A vehicle turns at an intersection and fails to yield to a pedestrian.
- A pedestrian steps into the road in the middle of a block where there is no crosswalk.
- A pedestrian walks or jogs in the road in the same direction as the traffic flow and fails to see an approaching vehicle
- A vehicle backs out of a driveway or parking space, and the driver fails to see a pedestrian
- A pedestrian is trapped on a crosswalk as the signal changes, and a vehicle fails to yield
- A car yields for a pedestrian, and another approaching car fails to see them on the crosswalk
It’s important to remember that drivers must take reasonable care to avoid harming pedestrians. Don’t assume that you can’t recover compensation without consulting a lawyer first. Shared fault does not always bar you from recovering a settlement.
