Truck Blind Spot Locations

All cars have blind spots, but trucks have the largest ones. There are several “no-zone” areas around large trucks where the driver can’t see. Many deadly accidents happen in these zones.

Commercial trucks are long, heavy, and much higher above the ground than other vehicles. This can lead to visibility issues around the:

• Front of the truck
• Back of the truck
• Driver or passenger side of the truck

According to the Federal Motor Carrier Safety Administration (FMCSA), drivers should avoid blind spots when a truck is changing lanes, turning, or backing up. It’s best to avoid these areas as much as possible when driving near a truck.

Truck drivers might miss smaller cars entirely if they are not careful. When an accident happens in this way, the injuries and damages can be terrible.

Who’s at Fault in a Blind Spot-Related Accident

Merely driving in a truck’s blind spot isn’t illegal. But when an accident occurs, one or more parties could be at fault. If you suffered injuries and the accident wasn’t your fault, you can seek compensation.

Truck drivers have a “duty of care” to avoid harming other drivers. That includes being mindful of their blind spots. They should be extra cautious before doing anything on the road around other automobiles.

The at-fault party in a blind spot accident could be:

• A commercial truck driver
• A van or SUV driver
• A passenger vehicle driver
• The trucking company
• A vehicle manufacturer
• A mechanic or repair shop

Blindspot crashes often happen because of driver error. The truck driver or another driver usually makes a mistake that causes the collision. Other times, a manufacturing defect or repair error could cause issues.

If a large truck is defective, it might have a larger-than-standard blind spot. Or, a repair shop could make a mistake that increases the chance of an accident. If the driver is an employee or a trucking company didn’t train them properly, the company could be liable.

You’ll need to know who is responsible before you can take action. It’s best to work with a Sandy Springs blind spot accident lawyer who can investigate. To discuss liability in your accident during a free consultation, call John Foy & Associates at (404) 400-4000 today.

Crashes that Often Involve Blind Spots

A blind spot can lead to an accident at any time. However, certain types of crashes are more likely to involve blind spots. Common examples include:

• Side-impact accidents
• Unsafe lane change collisions
• Left-turn accidents
• Rollover crashes
• Failure to yield accidents

Blindspot accidents can cause horrific injuries and damages. In the worst cases, a small car or motorcycle could become stuck under the truck. The truck might crush or drag the vehicle. Blindspot crashes can also involve multiple cars at one time.

Blind Spot Accident Damages

Drivers should try to avoid truck no-zones, but that doesn’t let the truck driver off the hook. If the truck driver is careless, they could be responsible for the damages.

Talk to a lawyer as soon as possible if you were injured. Another driver or company could be at fault for your crash and damages like:

• Medical bills
• Lost wages
• Lost earning opportunity
• Vehicle repairs or replacement
• Pain and suffering
• Scarring or disfigurement
• Wrongful death

You might have a personal injury claim or lawsuit against the driver or trucking company. If the accident involved reckless or wanton behavior, you might be entitled to punitive damages.

Talk to a lawyer to know your full legal rights before it’s too late. The statute of limitations in Georgia is usually two years from the accident date. In some cases, you have even less time to take action.

What a Lawyer Can Do for Your Case

Blindspot accidents are some of the most complicated in Sandy Springs. Several parties could be at fault, and you will need to gather evidence of what occurred to support your case. Also, it’s important to protect yourself from the beginning.

Trucking companies have their own lawyers and insurance adjusters to take action after an accident. They will start looking for ways to protect themselves and pay you less. But thankfully, you can level the playing field by hiring a blind spot accident lawyer.

Your lawyer can help your case by:

• Documenting the accident scene
• Talking to any eyewitnesses
• Compiling proof of your damages
• Calculating all of your losses
• Negotiating with the insurance company

Blindspot accident cases are typically complex. You’ll need a professional who understands the laws around these types of crashes. Schedule a consultation with an experienced attorney today to learn your legal options.
