What Can a Sandy Springs Car Accident Attorney Do for You?
The first and most important thing a Sandy Springs car accident attorney will do for you is listen to your side of the story. When you meet us for your free initial consultation, we will ask about the accident and your injuries to determine your optimal course of action.
After your lawyer assesses your case and you agree to hire them, they will:
- Investigate your accident
- Gather evidence of the other party’s negligence
- Calculate your damages
- Negotiate with the insurance company
- Fight for you at trial if necessary
It’s unlikely that your case will go to trial at all. Most of the time, the two parties settle outside of court. However, should your claim go to trial, your personal injury lawyer will do everything possible to win your case.
Car Accident Injuries Our Sandy Springs Lawyers Can Seek Damages For
Some of the most common car accident injuries our personal injury attorneys see include broken bones, head injuries, and cuts and bruises. But the most common of them all is whiplash, a neck injury that can be painful and long-lasting.
Whiplash can occur if your car is hit from the rear. The impact thrusts your head back and forward, causing small tears in your neck’s delicate muscles and tissues. Whiplash typically doesn’t show symptoms immediately, but it becomes painful over the next few hours, days, or weeks.
Whether you’ve suffered whiplash, a few minor scrapes, or a catastrophic injury, our experienced car accident attorneys from Sandy Springs can pursue the compensation you need to treat your injuries and manage long-term health effects.
Atlanta Roots, Nationwide Reach.
Distance is no obstacle. We work with clients across the country and make sure every one of them feels taken care of, no matter how far the call travels.
Compensation You Could Receive From a Successful Car Accident Claim
The damages you could receive from a car crash claim don’t differ much from the compensation available to truck accident victims and individuals injured in motorcycle accidents. Depending on the economic and non-economic losses you’ve taken on, our team may pursue several or more of the following remedies on your behalf:
- Medical bills
- Paychecks you’ve lost if you were unable to go back to work right after the accident
- Decreased earning ability
- Vehicle repair costs
- Pain and suffering
- Emotional distress
- Loss of enjoyment of life
If the driver was drunk or driving extremely recklessly, you may receive even more money in the form of punitive damages. These damages are intended to punish the drunk driver for their unacceptable behavior.
What Should I Do If I Am in a Car Accident?
If you’ve been in an automobile accident, you may feel rattled, but the first thing to do is take stock of yourself and anyone else involved. If anyone needs emergency medics, call for an ambulance. And while you’re on the phone with the dispatcher, ask a police officer to come to the scene.
Law enforcement response from the Sandy Springs Police Department on Morgan Falls Road can play an important part in the claim you make in the future for your injuries. The officer will talk to you and the other driver and file an accident report containing the officer’s view of what happened.
The police report is concrete evidence of when and where the accident occurred and can help establish who the at-fault party is. In addition to talking to the police, you can do other things to make getting money for your vehicle damage and injuries easier. They include:
- Exchanging information: Exchange your driver’s licenses and information about your car insurance policies. You can use your cell phone camera to take pictures of the other driver’s license and insurance card.
- Speaking to witnesses: Talk to anyone else at the scene who might have seen the accident or has something else helpful to say. Take notes and write down their phone numbers and names.
- Taking photos: Take photos of anything you think might be important. This includes vehicle and surrounding property damage, the accident scene in general, skid marks, road conditions or obstructions, and anything else that could help show how the accident happened.
- Telling the police about intoxicated drivers: If you suspect impaired driving played a role in the crash, tell the police officer. This will increase the chances that the officer will administer a sobriety test and arrest the driver on the spot. This outcome would help your claim and improve your chances of receiving maximum compensation.
- Taking notes on the effects of the crash: Keep a record of what happens to you after the car accident. Write down how the accident made you feel and how your injuries impacted your daily life. You should also keep track of all costs associated with your car accident, including vehicle repair costs and medical expenses.
- Seeking medical care: After leaving the scene, see a doctor as soon as possible to have your injuries checked out. Some auto accident injuries take a while to show up; therefore, see a doctor even if your pain is minor. The sooner you can get treatment and create a record that you saw someone for your injuries, the better it is for your case.
- Protecting your rights: Be careful about what you say and do after a car accident. Don’t take the blame, apologize, or play down your damage. Anything you say could be used against your claim. Hiring a skilled lawyer to communicate with insurers and other relevant parties will help you protect your right to financial compensation.
Consult With an Auto Accident Lawyer in Sandy Springs
Contact a trusted personal injury lawyer in the next day or two after the accident. An auto accident attorney in Sandy Springs can help you deal with the insurance company, answer any questions you have about your claim, and set you on a path to getting a fair settlement for your injuries.
It’s easy to get taken advantage of if you don’t know how to handle the insurance claim adjusters, so a lawyer can make sure that doesn’t happen. If the insurance company or at-fault driver fights against your claim, John Foy & Associates will be there every step, even if you must take the driver to court.
Filing Deadline for Car Accident Lawsuits in Sandy Springs
Georgia has a strict deadline for filing a claim for car wreck injuries. According to the statute of limitations, which can be located in Ga. Code § 9-3-33, claimants usually have two years from the accident date to file a legal claim.
However, sometimes the deadline can be much shorter. If you don’t file your claim in time, the local courts will refuse to hear your case, and you will lose the right to get money.
Don’t let this happen to you; don’t let yourself be shortchanged by the insurance company. Get an experienced Sandy Springs car accident lawyer on your team. A lawyer can help you stay on top of deadlines and make the strongest possible case to get you the money you need.
How Much Does a Car Accident Lawyer in Sandy Springs Cost?
Thankfully, because of our contingency fee policy, the cost of an attorney isn’t something you have to worry about. We take nothing upfront and only get paid when you win your case. Our fees come from your winnings, so you don’t have to pay anything out of pocket.
At your initial consultation, your car accident attorney in Sandy Springs will assess your case and tell you how much they think their fees will be. You two will agree on a percentage of your settlement that will go to them, and then they will work to ensure you get what you need.
Sandy Springs Car Accident Lawyer FAQs
Even after reading through the details above, you may still have questions about your specific situation. Here are answers to some of the most common questions our Sandy Springs car accident attorneys hear from injured clients.
What if I Was Partially at Fault for the Car Accident?
You can still recover compensation if you were partially at fault for a car accident in Georgia, as long as you are less than 50% responsible. Georgia follows a modified comparative negligence rule, so your final settlement is reduced by your share of the blame.
Insurance companies often try to push more fault onto you to lower what they owe. At John Foy & Associates, our Sandy Springs car accident lawyers fight those tactics by gathering evidence and telling your side of the story so you are not blamed for a crash that was not really your fault.
How Long Will My Sandy Springs Car Accident Case Take to Settle?
Most car accident cases settle within a few months to a couple of years, depending on the severity of your injuries and how clearly fault can be proven. Straightforward claims wrap up faster, while cases with serious injuries or lawsuits filed in Fulton County State Court can take longer.
Rushing is rarely a good idea, since you cannot go back for more money once you accept a settlement. Our team at John Foy & Associates moves your case forward as quickly as possible while making sure you are not shortchanged on the way.
Do I Need to See a Doctor Right Away After a Sandy Springs Car Crash?
Yes, you should see a doctor right away after a car crash, even if you feel fine. Serious injuries like whiplash, concussions, and internal bleeding do not always show symptoms in the first few hours. Delaying care also gives the insurance company an easy excuse to argue your injuries were not caused by the accident.
Sandy Springs residents have quick access to emergency care at Northside Hospital Atlanta and other nearby facilities, so there is no reason to wait. John Foy & Associates recommends getting checked out first, then calling a car crash lawyer in Sandy Springs to protect your claim.
