Despite the rules and regulations established to protect people against injuries in Georgia, accidents continue to happen daily. Unfortunately, some accidents occur due to negligence and reckless actions of other parties. If you or your loved one has sustained a personal injury caused by a negligent party, Georgia law might allow you to pursue compensation and recover losses.
At John Foy, we understand how overwhelming the legal process of personal injury claims can be, especially when you suffer life-threatening injuries. Working with our personal injury attorney in South Fulton can help you defend your rights, determine fault, and recover maximum compensation. Besides, we handle everything on your behalf, allowing you to focus on your health and recovery.
Establishing Liability in a Personal Injury Claim
Georgia follows the modified comparative negligence system when establishing liability, provided your fault is less than 50%. When proving fault in a personal injury claim, a personal injury lawyer in South Fulton can use the below elements to establish liability:
- Duty of care: The other party owed the victim a duty of care.
- Breach of duty of care: The other party’s actions or inactions breached the duty of care.
- Causation: The other party’s actions led to the victim’s injuries.
- Damages: The injuries suffered due to the other party led to various damages, such as lost income and medical expenses.
At John Foy, our personal injury lawyer can help you hold the responsible party liable and receive compensation for your injuries. Our goal is to ensure you recuperate from your injuries while we recover the damages caused by the accident.
Filing a Personal Injury Claim in South Fulton
According to state law, OCGA §9-3-33, personal injury claims have a two-year statute of limitations in Georgia. This period begins from the date the injury occurred, and victims must take legal action within two years or get their claims dismissed by the court.
Working with an experienced South Fulton personal injury attorney can ensure you file your claim within two years and avoid missing the deadline. This includes preparing the documentation and meeting all legal requirements to file a personal injury case in Georgia. If you sustain an injury and believe the other party caused the accident, our injury lawyer at John Foy can help you file you.

What Should You Do After a Personal Injury Accident in South Fulton?
Remaining calm and figuring out what to do after a personal injury accident is essential, mainly when a negligent party led to the accident. This increases your chances of obtaining compensation and recovering your losses. If you were involved in an accident and sustained an injury, here is what to do:
Get Medical Treatment
Since your health and wellbeing are critical, get medical treatment as soon as possible after an injury. Even if your injuries seem less severe, obtaining treatment helps determine the extent of the damage and prepare a medical report.
Gather Critical Evidence
Take photos or record videos of the scene and your injuries to obtain evidence that might support your claim. In addition, get witnesses’ names and contact information, including a summary of their statements.
Report the Incident
Contact the police and other relevant authorities to report the accident. A police report can help establish liability and be used by your insurance carrier.
Hire an Experienced South Fulton Personal Injury Lawyer
After a personal injury accident, it is important never to admit fault but contact a qualified South Fulton personal injury lawyer to understand your rights. A lawyer can also help establish responsibility and prepare a claim against the at-fault party.
