Amazon Delivery Van Accidents Are Increasing

We’ve seen more Amazon driver-related accidents for several reasons:

• More Amazon customers are using one-day delivery services for their packages. This increases the need for extra drivers who don’t have commercial driver’s licenses (CDL).
• Many Amazon drivers are independent contractors, not employees. Without special training or supervision, inexperienced drivers are more likely to cause accidents.
• More orders increase demand and urgency. Drivers can feel pressured to deliver shipments faster, which can contribute to stress-related accidents.

Delivery van accidents make up some of the most serious collisions. If an Amazon driver caused your accident, you might have painful injuries and other damages. Talk to a lawyer today about filing a claim for financial recovery.

Inexperience Often Leads to Amazon Delivery Van Accidents

Amazon delivery drivers are at a disadvantage compared to other motorists. For example, FedEx and UPS drivers drive similar routes every day. But Amazon deliveries can change drastically from day to day.

Many Amazon drivers are also contractors instead of employees. They may not need additional qualifications to deliver packages for the company. This is concerning since transportation accidents make up 40% of work-related deaths, according to the Bureau of Labor Statistics (BLS).

Independent Contractors for Amazon

Amazon has a ridesharing program called Flex. Under the Flex program, drivers also work as contractors. The need for quick deliveries and ridesharing services has led to a rise in independent drivers. Since the drivers aren’t employees, it can be harder for victims to recover compensation after an accident.

If an Amazon contract driver caused your accident, you can probably hold the driver responsible. However, you will have a harder time holding Amazon liable. There are situations where the company could be at fault, but you’ll need help proving it with an experienced lawyer.

How to Determine Fault in an Accident with an Amazon Driver

Amazon often avoids fault for accidents with Amazon drivers. The victim might file a claim with the insurance company and move on. However, it’s important to investigate the actual cause of the accident.

Georgia is a “fault” state. That means the at-fault party in an accident is responsible for the damages. As the injured party, you can seek compensation from the at-fault party.

The responsible party in an Amazon delivery van accident could be:

• The delivery driver
• Amazon
• A vehicle manufacturer
• A repair shop

If the driver is an independent contractor, they may be personally liable. That would mean filing a claim with the driver’s insurance company. In some cases, an accident happens because of vehicle defects or faulty repairs. If Amazon was negligent in hiring the driver, it could be partially at fault.

If someone other than the driver is at fault, contact a lawyer. You’ll need help investigating how the accident happened. A lawyer can also help you gather evidence to prove fault.

John Foy & Associates can examine your case and determine who is responsible. We’ll answer your questions and help you fight for fair compensation. To learn more during a free consultation, call (404) 400-4000.

Situations Where Amazon Could Be at Fault

There are a few situations where Amazon could be liable for a delivery van accident. For example, the company might hire a driver with:

• A suspended driver’s license
• A dangerous driving record
• Clear alcohol or drug use
• A condition that makes them unsafe to drive

Amazon must be responsible when hiring drivers. If the company is negligent in this area, it could be at fault.

Large companies like Amazon will fight a claim against them. If Amazon might be responsible for your accident, speak with an experienced lawyer. A lawyer can investigate to gather the right evidence.
