DHL Trucks and Accident Liability

DHL is a German company that was founded in 1969 and soon expanded to the United States. Its American headquarters are in Florida, and it’s one of the largest delivery companies. DHL competes with other delivery companies like UPS, FedEx, and USPS.

If a DHL truck driver caused your accident, the company is probably liable. Under the Official Code of Georgia Annotated (OCGA) §51-2-2, employers in Georgia are responsible for their employees’ actions. If the driver was working within their employment scope, you likely have a case against DHL.

Driver carelessness can lead to accidents like:

• Distracted driving accidents
• Jackknifing accidents
• Rear-end or head-on collisions
• Poorly-loaded cargo crashes
• Drunk driving accident

Some delivery companies work with independent contractors. If the driver was a contractor, liability laws are different. Companies are not responsible for a contractor’s actions, so you might have a case against the driver in that case.

You’ll need to investigate the cause of your accident. The facts will help show who is liable and where you can file an injury claim.

Common Causes of Delivery Truck Accidents

DHL truck accidents often happen because of a driver’s actions. For example, the driver might speed so that they can deliver packages faster. They could become distracted by their cell phone. Or, a driver might be under the influence of drugs or alcohol.

Besides driver negligence, other causes of DHL truck crashes include:

• Defective truck parts
• Poor truck maintenance
• Incomplete driver training
• Incorrectly-loaded cargo

Driver fatigue is also common in truck accidents. When someone drives a vehicle for a living, they should take regular breaks to avoid burnout. Also, companies should provide enough time for drivers to rest.

If a truck driver is low on sleep or work breaks, it can lead to severe fatigue. Driver fatigue is often as dangerous as drunk driving. A tired driver can make careless mistakes that lead to terrible accidents.

If you were injured in a DHL truck accident, you could have a claim against the driver and their employer. It’s important to know the cause of the accident before building your claim, so talk to a lawyer who can help you investigate.

DHL Truck Accident Damages

Any losses from a truck accident are known as your personal injury damages. Common damages include:

• Medical bills
• Medication costs
• Lost wages
• Loss of earning capacity
• Vehicle damage
• Pain and suffering
• Mental anguish

Many accident victims are surprised to learn all of their damages. For example, you might have long-term treatment needs that add up over time. Or, the accident could leave you with physical and emotional suffering.

It’s important that you know all of your damages before filing a claim. Otherwise, you could end up paying for costs that you didn’t cause. Talk to a DHL truck accident lawyer in Sandy Springs to discuss the details.

At John Foy & Associates, we can help calculate the full value of your damages. That includes emotional damages that don’t have a set dollar amount. To learn more during a free consultation, call (404) 400-4000 or contact us online.

Gathering Evidence for a DHL Truck Accident Claim

If a driver or company was at fault for your accident, you have rights. You can seek compensation through a personal injury claim or lawsuit. However, your case won’t be successful without evidence.

After the collision, gather any information you can, such as:

• A copy of the accident report
• Photos from the accident scene
• Copies of medical bills and records
• Eyewitness statements
• Other evidence of your costs

If you have life-threatening injuries at the scene, have someone call for an ambulance. Your well-being is the number one priority, so don’t wait to get help. If you don’t get treatment at the scene, see a doctor as soon as possible.

The company’s insurance company will fight back after you file your claim. If you don’t have evidence of your damages, the insurer will use it against you. So, save everything you can and get medical attention immediately.
