Let Our Head-On Collision Lawyers Help You Win a Settlement
When it comes to car accident claims in Georgia, you need to prove that you were less than 50% responsible for your accident. This is due to the comparative fault law under the Official Code of Georgia Annotated (OCGA) §51-12-33. So long as you’re less than 50% responsible, you can file a claim, but whatever percentage you are responsible for will get deducted from your settlement.
The comparative fault law is exactly why retaining a lawyer is the best thing you can do for your accident. You need to prove who is at fault for your accident by building a strong case before filing your claim. Building a strong case requires:
- Good legal knowledge.
- Strong evidence that supports your side of the story.
- Good negotiating skills.
If you don’t have any prior legal experience and don’t know where to begin collecting evidence, reach out to the head-on collision attorneys at John Foy & Associates as soon as possible. Evidence is time-sensitive and can decay the more time passes, which ultimately serves to weaken your ability to receive fair compensation.
Recovering Compensation for Your Damages
You should always try to settle for the maximum amount of compensation you can. How much your settlement is worth will depend highly on the types of damages you sustained from your head-on collision. For most head-on collisions, you can recover compensation for:
- Pain and suffering
- Emotional trauma and mental anguish
- Lost wages and reduced earning capacity
- Vehicle repairs and replacements
- Various property damages
- Medical expenses such as physical therapy, surgery, hospital visits, prescriptions, equipment, etc.
- Loss of enjoyment of life
- Disability or disfigurement
- Wrongful death
- Loss of consortium
Our attorneys will use your receipts, invoices, and bills to calculate all of your economic damages, such as lost wages or medical expenses. For non-economic damages, it gets a bit more complex. Non-economic damages don’t have fixed values associated with them, so we will use:
- Various formulas
- Case history
- The magnitude of your damages
To accurately assess how much your non-economic damages, such as pain and suffering, are worth. Don’t worry, our attorneys know how important it is to get your settlement amount right, and we will ensure that every penny gets accounted for.
