Proving Fault in a Head-On Accident
Georgia is a fault state. Here’s what that means:
- The careless person in an accident is responsible for the costs.
- If you are the victim of an accident, you can seek compensation for your expenses.
- You can recover damages as long as you were less than 50% at fault.
Head-on accidents are often straightforward. Causing a head-on collision usually involves reckless or impaired behavior.
If someone was at fault for your accident, you can gather evidence of their carelessness.
Common Accident Causes
A head-on crash can happen for many reasons. Some of the most common causes include:
- Distracted driving
- Drowsy or fatigued driving
- Aggressive driving
- Reckless driving
- Driving under the influence (DUI)
- Speeding
- Moving across the center line
- Driving too fast around a curve or up a hill
Head-on accidents often happen on two-lane roads without dividers. Many of these roads are in rural areas where it’s easy to veer into an oncoming lane.
It only takes a second for someone to move into another lane. Before the victim knows what’s happening, they can become the victim of a crash.
Your Compensation Options
If you didn’t cause your accident, you have rights. You can seek compensation through a personal injury claim, according to the Official Code of Georgia Annotated (OCGA) §51-12-4.
A Macon head-on collision lawyer can help determine your lost wages. Personal injury damages are any losses that result from your injuries.
Here are some common damages you might have:
Medical Costs
Medical costs often make up the most substantial part of a head-on accident. The force of a head-on collision can cause severe or life-threatening injuries.
Medical costs might include:
- Doctor bills
- Hospital bills
- Prescription medications
- Physical therapy or rehabilitation
- Future medical care
- Assistive medical devices
It’s best to wait until you’re fully healed to file your claim. That way, you can know your total medical costs—including future treatment needs.
Also, see a doctor as soon as possible after your accident. Getting prompt medical treatment will protect your rights in a couple of ways.
Your doctor can determine the prognosis for your injuries. You’ll know if you need ongoing or future treatment. You’ll also know how your injuries will impact your life going forward.
Seeing a doctor also creates a record of treatment for the insurance company. If you wait too long, that will work against your case.
Lost Wages
Were you working before the accident? If so, your injuries might prevent you from returning to work.
Some victims have to take a brief time off. Others are unable to return to the same job. Some accident injuries can lead to permanent disabilities that affect the ability to make income.
A Macon head-on collision lawyer can help determine your lost wages. If you have to stop working or take on lower-paying work because of the accident, you might deserve additional damages.
Vehicle Damage
Head-on accidents often leave vehicles in terrible shape. However, you shouldn’t have to pay if you were not at fault.
Your claim can include the costs of repairing or replacing your car.
Pain and Suffering
You can include non-economic damages in your claim, too. Pain and suffering damages are about how the accident impacts your life.
Examples include:
- Physical pain and suffering
- Mental pain and suffering
- Loss of enjoyment of life
- Scarring or disfigurement
- Anxiety or post-traumatic stress disorder (PTSD)
Your lawyer can help determine these damages. The law does not require monetary proof, but you’ll still need to put a dollar value on them.

How Insurance Claims Work
All drivers must carry the minimum insurance coverage. According to Geico, the minimum in Georgia is:
- Bodily injury liability: $25,000 per person and $50,000 per accident
- Property damage liability: $25,000 per accident
Drivers can also carry option uninsured motorist coverage. Unless a driver opts explicitly out of this coverage, they probably have it.
When a driver causes an accident, their insurance pays for the other driver’s damages. However, insurance companies don’t make the process easy.
Insurance Company Tactics
Insurance companies will look for any reason to pay you less. They are for-profit companies that care about their money. They’re looking to settle or end claims as soon as possible.
Look out for insurance company tactics like:
- Calling you to ask for a recorded statement
- Offering you a meager insurance settlement
- Blaming you for the accident
- Suggesting that your injuries aren’t that bad
- Downplaying or questioning your damages
Remember: the insurance company is not your friend. Even if the adjuster seems friendly, they are not on your side. They’ll try to undervalue each damage that you have. A free consultation lawyer in Macon can determine the true value of your claim after reviewing your case at no cost.
