A fender bender in a parking lot might look minor at first glance, especially at slow speeds where no airbags deploy. But that kind of impact can still cause a herniated disc, a fractured wrist, or a torn knee ligament, even more so if a pedestrian gets hit instead of another car.
A parking lot accident lawyer in Mableton knows insurance companies dismiss these claims as low-value before anyone’s even seen a doctor, let alone learned the true extent of their injuries.
John Foy & Associates has recovered over $1 billion for injury victims across Georgia, and our team of Mableton car accident lawyers is ready to bring that track record to your case. Get in touch today for a free consultation.
Common Causes of a Parking Lot Accident
Most parking lot accidents come down to a handful of recurring mistakes:
- Backing out of a space without checking for oncoming traffic or pedestrians
- Distracted driving, like checking a phone or GPS while creeping through the lot
- Speeding through the lot or cutting through parking aisles like a through-street
- Failing to yield at posted stop signs or in marked crosswalks
- Blocked sightlines from parked cars, shopping carts, or poor lighting
- Icy, unmarked, or poorly maintained pavement
Figuring out exactly which of these caused your crash matters more than it might seem, because it determines who was legally at fault, and in some cases, whether more than one party shares the blame. A Mableton personal injury lawyer uses that cause to build the foundation of your claim.
Who May Be Liable for Your Losses in Mableton
In parking lot crashes, the driver who backed out carelessly, ran a stop sign, or was distracted behind the wheel is the one legally responsible for your injuries. Georgia law requires drivers to exercise reasonable care no matter where they’re driving, and a parking lot is no exception.
But the driver isn’t always the only party who may be liable. If poor lighting, potholes, faded signage, or a lack of security contributed to the crash, the property owner or management company could also share responsibility under Georgia’s premises liability laws.
John Foy & Associates looks at every angle of your crash to identify everyone who may owe you compensation, not just the most obvious party.
Evidence That Can Strengthen Your Claim
Parking lots often come with more built-in evidence than a typical roadway crash, if you know where to look. Store surveillance cameras frequently capture the moment of impact, along with the lead-up to it, which can settle disputes over fault before they even start.
Beyond footage, witness statements from other shoppers, photos of vehicle positioning and damage, and a copy of the property’s incident report (most stores keep one) can all help paint a clear picture. A parking lot accident attorney in Mableton knows how to request each of these before they disappear.
How Timing Can Affect Proof
Most stores only keep surveillance footage for a matter of days or weeks before it’s automatically overwritten, which means the strongest evidence in your case can vanish quickly if no one asks for it. Contacting a lawyer soon after your crash gives your legal team time to send a preservation request before that window closes.

Injuries Often Seen After Parking Lot Accidents
Parking lot crashes involving pedestrians tend to cause more severe injuries, since there’s no vehicle frame to absorb the impact. Common injuries include:
- Whiplash and soft tissue injuries
- Fractures, usually in the hips, legs, or wrists
- Knee and joint injuries from direct impact
- Head injuries and concussions
- Back injuries, including herniated discs
Even crashes that look minor on the surface can leave you with injuries that take weeks or months to fully diagnose, which is one more reason not to accept a quick settlement offer before you’ve seen a doctor.
What Compensation You May Be Able to Recover
Depending on the details of your case, John Foy & Associates may be able to help you pursue compensation for:
- Medical bills, both current and future
- Lost wages if your injuries kept you out of work
- Pain and suffering
- Property damage to your vehicle
- Long-term or permanent disability
Insurance companies often use the “low speed, low impact” assumption to justify a lowball offer. Our Mableton parking lot accident lawyers push back on that assumption with solid evidence of what your injuries have actually cost you.
How Georgia Fault Rules May Affect Your Case
Georgia follows a modified comparative negligence rule, and it applies just as much in a parking lot as it does on the highway. If you’re found partially at fault for the crash, your compensation can be reduced by your percentage of fault, and you can’t recover anything if you’re found 50% or more responsible.
Parking lot crashes tend to generate more fault disputes than typical road accidents, since there aren’t always clear lane markings or right-of-way rules governing every aisle and intersection. That ambiguity is exactly what insurance companies use to shift blame onto you.
A parking lot accident lawyer in Mableton works to make sure fault gets assigned accurately, not just however the insurance company prefers to see it.
