You don’t Have a Long Time to File a Claim
After a car accident, you may wonder how long you have to file a claim to receive compensation. Under the Georgia code, you have just two years to file from the date of your accident. Don’t underestimate just how short this time can be, as many people have missed their deadline and thus lost their ability to obtain a settlement for their damages.
Building a strong case prior to filing takes time, and so does receiving proper medical treatment. We recommend that you contact the attorneys at John Foy & Associates as soon as you can after your food delivery car accident.

Who Is at Fault for a Food Delivery Car Accident?
Two principal parties can be at fault for a food delivery car accident.
The Negligent Food Delivery Car Driver
As expected, you can hold the driver of the food delivery car responsible for your damages if they were acting negligently on the road. For example, if they were drunk, high, driving recklessly, driving distracted, or blatantly ignoring set traffic rules, they failed to uphold their duty of care for others.
Because of this, you can pursue a claim against them and recover compensation from their insurance company. Our lawyers will seek to get you the maximum amount of compensation you’re entitled to.
The Food Delivery Company
Food delivery companies have a duty of care as well. They must perform essential background checks and ensure that their drivers are:
- Properly licensed
- Have no criminal history
- Have a good driving record
Failure to do so means that they were negligent in their hiring practices which directly put other people at risk. While it can be difficult, our lawyers will help you negotiate a fair settlement with the food delivery company.

Distance is no obstacle. We work with clients across the country and make sure every one of them feels taken care of, no matter how far the call travels.
Comparative Fault in Georgia
The Official Code of Georgia Annotated (OCGA) §51-12-33 outlines the state’s comparative fault laws. Essentially, you can’t be more than 50% responsible for your accident. If you are, then you can’t file a claim against the other driver. Any percentage that you are found responsible for will get deducted from your final settlement award.
It is best not to have any fault associated with you at all. This is why it is absolutely critical that you have a strong case and strong legal representation to absolve you of any guilt. You should always expect insurance companies and the defense to try and shift the majority of the blame onto your shoulders.
Fight Back Against Insurance Companies
At the end of the day, insurance companies are businesses. Their interests aren’t in helping you get a fair settlement. They simply want to give you the least amount of compensation possible and call it a day.
Insurance adjusters will try to convince you that hiring a lawyer isn’t worth it. That most law firms seek to exploit their clients and just make off with absurd amounts of legal fees. While this is true for certain untrustworthy and unethical firms, it isn’t with John Foy & Associates.
With more than two decades worth of legal experience, we have settled cases that have totaled over $1 billion in verdicts and settlements for our clients. We never charge any upfront or hidden fees whatsoever. In fact, if we can’t win you compensation, you owe us absolutely nothing.
