Our Side-Impact Collision Lawyers Will Help You Recover Compensation
You can recover an award for three types of damages in Georgia: economic, non-economic, and punitive.
Economic Damages
All economic damages have a fixed monetary value to them. In other words, the amount they’re worth doesn’t fluctuate, and you can often calculate them through bills, invoices, receipts, and different types of financial documents. Economic damages primarily consist of:
- Medical expenses
- Assisted living and substitute services
- Lost wages and reduced income
- Vehicle repairs or replacements and property damages
Remember to keep proof of your economic damages safe, as our lawyers will use them to ensure that they get accurately reflected in your settlement.
Non-Economic Damages
Non-economic damages are the opposite of economic damages which means they don’t have fixed monetary values. How much your non-economic damages are worth depends highly on their severity and context in relation to your accident. Most non-economic damages typically include:
- Loss of consortium or enjoyment of life
- Wrongful death
- Pain and suffering
- Mental anguish
- Disability
- Disfigurement
Our side-impact collision lawyers will examine your case thoroughly to determine all of your non-economic damages and their value. Because there is no fixed value, we will usually use several different formulas, case histories, and other factors to assign an accurate value to your damages.
Punitive Damages
Punitive damages aren’t really damages per se. The Official Code of Georgia Annotated (OCGA) §51-12-5.1 states that they’re mainly a type of punishment that gets put upon the at-fault party if the actions that caused your accident:
- Involved fraud
- Caused severe damages to you and others
- Were egregiously negligent
- Were committed with the intent to harm or kill others
If the facts of your side-impact collision meet these criteria, there is a chance our lawyers can help you get an award for these punitive damages. Even though not every case can qualify, we will do our best to get you this additional award if possible.
Will My Case Settle Out of Court?
Most side-impact collision claims settle out of court for two reasons:
- You accepted the initial settlement offer from the insurance company.
- You retained a lawyer, which helped you get the settlement you need.
You don’t want to accept the initial settlement offer because it’s often way below what you actually need for your damages. Insurance companies often pressure you hard to take their settlement without legal representation because they want to end your pursuit for a fair settlement fast.
When you retain a lawyer, most insurance companies won’t want to go to court because of how costly it will be for them in the long run. Your lawyer can help you get all the evidence you need to have a strong case. This will prevent the insurance company from stalling and instead negotiate for a settlement on your terms.
Can I Trust a Lawyer to Help Me Win?
Many people have an aversion to seeking legal aid for their case, and we understand why. There are many shady law firms out there with lawyers that do nothing but steal money away from their clients. With excessive legal fees and half-baked legal services, it’s not any shock to us that many car accident victims shy away from retaining a lawyer.
The side-impact collision attorneys at John Foy & Associates embody the principles of what makes a good car accident lawyer. We won’t hesitate to fight hard for your rights and to make your voice heard during a trial or negotiation. There are no upfront fees with our services, and we don’t accept any payment unless we win your case.
