What to Do After an Uber Accident in Jonesboro, GA
If you get into an Uber accident, there are essential steps you should immediately take to help protect your rights and increase your chances of having a successful outcome in your case.
Call the Police
After finding yourself in an Uber accident and ensuring you have not sustained any fatal injuries, you need to call the police. Complete the accident report form and provide any details you feel are relevant to the accident. Having official documentation showing who is at fault will help you file a claim against a careless driver.
Your claim may be denied if you do not call the police immediately after your accident. No matter how apologetic the other driver seems, do not fail to make a police report. You may risk the insurance company denying your claim if you do not have documentation stating who is at fault.
Gather Detailed Evidence
Make sure you gather as much evidence as you can. If possible, take photographic evidence of the accident scene, especially the road and weather conditions that may have contributed to the accident. Take pictures of any damage to your car and the injuries sustained.
Pictures can be beneficial in a trial. Presenting photographic evidence in court will show the judge the extent of the damage, helping them better understand what happened. While the police report may have a lot of information, you should gather additional evidence if you have sustained injuries.
Note Down All the Details
Memories of the accident become foggy with time, so you want to have all the essential information while the scene is still fresh in your mind. Write down the driver’s name, their vehicle number plate, and the exact time and location of the accident. Remember to take the names and the contact information of any witnesses at the scene.
Seek Medical Assistance
You should see the doctor shortly after your Uber accident. Keep all records of your medical expenses, as they will be used as evidence when you file a compensation claim.
The Don’ts After an Uber Accident
If you file a claim against an Uber driver, you should be able to prove, beyond a reasonable doubt, that the driver was responsible for your injuries. Right after your accident and as you build your case, do not do these things:
- Even if you feel you are to blame for the accident, never admit fault. Talk to your lawyer about your involvement, but not to other third parties.
- Refrain from arguing with the parties at the scene.
- Never accept any settlement offer suggested by the defendant or their insurer without your attorney reviewing the claim.
- Do not participate in any negotiations with the defendant without including the insurance company or your lawyer.
Determining Liability in a Jonesboro Uber Accident
This is where ridesharing accidents become complicated. Uber drivers work as independent contractors as opposed to employees. This means that liability does not automatically fall on the driver when an accident happens.
Suppose you have been injured by an Uber driver or were a passenger in an Uber vehicle in the accident. In that case, you will need to go over the Uber insurance policy to determine how liability works. It is important to understand that if the case is analyzed and it is established that the Uber driver is not at fault for the accident, you will have to follow up with the other driver’s insurance policy to get compensated for your injuries.

Depending on how severe your injuries are, you may miss some days off work or have to quit your job altogether. Georgia law requires you to be compensated for past and future lost wages.
- Pain and Suffering
Injuries sustained from your accident will hurt. You will experience physical, emotional, and psychological pain. And if someone else’s negligent actions caused this pain, you deserve compensation for that pain and suffering.
- Medical Expense
Your lawyer will ensure you are compensated for financial damages incurred due to past and future medical expenses. Just because the lawsuit is over does not mean you will not incur additional medical expenses. If you sustain serious injuries, you may need years of medical treatment.
