Liability for Cartersville Uber Accidents

Establishing liability is critical if you hope to be awarded maximum compensation for your damages. Liability must be proven based on a preponderance of the evidence for your case to be successful. The four following elements of negligence will need to be met:

• Duty of care
• Breach of duty
• Causation
• Damages

Other Parties Who May Be Liable for Your Crash

In the vast majority of Uber accidents, driver negligence plays a part in the cause of the accident. Generally, the Uber driver or other liable driver will have engaged in some type of unsafe driving practice. However, there are ultimately multiple parties who could share fault for the injuries you sustained depending on the cause of your accident.

Some of these parties could include:

• The Uber driver
• Other liable drivers
• Passengers
• Auto parts manufacturers
• Motor vehicle dealerships
• Vehicle maintenance technicians
• Dram shops
• Uber
• Other third parties

Georgia Modified Comparative Negligence Laws

Sharing fault for motor vehicle accidents in Cartersville is not uncommon. You can expect the liable party to argue that you are partially responsible for causing your Uber accident injuries, as Georgia follows a modified comparative negligence system.

Here, if your portion of liability exceeds the 49% threshold, you will lose your right to financial compensation through the Cartersville civil courts. However, if you share liability, you also need to prepare for your injury settlement to be reduced. Your Uber accident injury settlement will be reduced to reflect your portion of the liability.

For example, if you are found 25% liable for your injuries for failure to wear a seatbelt, you could expect your injury settlement to be reduced by 25% as well. For this reason, you need to take action to retain a dedicated legal advocate who will ensure liability is equitably assessed in your case.

How Insurance Claims Work for Uber Accidents in Cartersville

One of the most important parts of the Uber accident claims process is dealing with the insurance company. Georgia is a fault state for car accidents and insurance purposes, so you will need to file a claim with the liable party’s insurance provider.

Fortunately, Uber provides its Uber drivers with a $1 million auto insurance policy. However, this policy is only in effect during specific times, including:

• When the driver is in driver mode
• When the driver is waiting for a passenger
• When the driver is transporting a passenger
• When the driver is en route to a passenger

If your Uber accident occurred outside of these times, Uber’s auto insurance policy will not be in effect. Instead, the Uber driver’s own personal auto insurance policy will be active. If the Uber driver does not have adequate insurance to cover your needs, you may be able to file a claim with your own auto insurer if you purchased uninsured or underinsured motorist coverage.

Compensating Uber Accident Victims in Cartersville

After an Uber accident, it is normal to wonder how much you could be awarded if you chose to pursue your claim. However, the way in which Uber accident victims are compensated in Cartersville can be complex. Here is everything you need to know:

How to Recover Maximum Compensation for Your Uber Accident Damages

If you hope to recover maximum compensation for your Uber accident damages, you need to be prepared to file a claim with the insurance company and bring your case to court.
