What to Do After Being Involved in an Uber Accident

Vehicle accidents are inevitable. Accidents are serious, whether it is your typical vehicle or a rideshare accident. They often result in injuries that can be severe or even life-threatening.

What you do following your involvement in an uber accident is essential. There are things you should and should not do following an accident. They include the following.

What You Should Do:

• Call the police immediately to report the accident.
• Seek medical attention for any injuries sustained (this is important whether you have visible or known injuries or not).
• Take note of incident (photos, statements, road conditions, contact information of involved parties).
• Contact an experienced car accident lawyer.

What You Should Not Do:

• Claim fault of the accident.
• Decline medical attention.
• Speak to the insurance companies without legal representation.

Keep These Tips in Mind

It is essential to keep these dos and don’ts in mind after being involved in an Uber accident. This will lessen the possibility of you putting your claim at risk. You want to ensure you are keeping your best interest in mind and protecting your rights following an Uber accident.

To ensure proper handling, consult an Austell personal injury lawyer today.

Uber’s Required Insurance

Like many rideshare companies, Uber doesn’t consider their drivers as employees. Instead, they hire their drivers as contractors. This is a security measure in their favor. They may be able to avoid certain liabilities, but not all of them.

On a related note, Uber requires its drivers to purchase special insurance. This insurance must meet state-enforced minimum monetary liability coverage. In addition to the driver’s insurance, Uber has insurance that covers their drivers as well.

They will require the driver’s insurance to be the initial insurance to be filed against. If the filed claim is denied, Uber’s insurance will come into play to protect the company. Uber is defending itself in this instance, and you should do the same for yourself.

Rideshare Accident Claims

Filing a claim after you have been involved in an Uber accident is your right. Do not be eager to accept the first figure offered to you. Rideshare companies are like many other companies and look out for themselves rather than the accident victim.

You may be owed a lot more than you may think following your accident. It is best to file a claim against the rideshare company and their insurance company by consulting an Austell Uber accident attorney to take on your claim.

Recoverable Damages to Include in your Claim

Due to the extreme loss that can result from a vehicle accident, you may have the right to recover damages lost in the rideshare accident. This will depend on the investigation into the factors determining the fault of the accident. Some of the recoverable damages include:

• Property damage
• Loss of wages due to inability to work
• Medical expenses for treatments needed as a result of the accident
• Pain and Suffering
• Rehabilitation costs, if applicable
• Prescription expenses as they pertain to sustained injuries
• Damage to personal belongings
• Emotional distress
• Future wage loss as a result of the accident

In the extreme instance where death results from an accident, you are entitled to collect wrongful death damages. There are restrictions around the relation of the victim, but an experienced Austell Uber accident lawyer will be able to give more information regarding your rights. Actual damages are pending the evaluation of your case.

Compensation Awarded for Accident Claims

Compensation is not something easy to determine. Our goal is to get you a fair settlement. The compensation details can not be determined until an experienced attorney has evaluated the details of your claim.

Compensation is usually awarded based on multiple factors, including both economic and non-economic damages. We do not recommend accepting offers for compensation without consulting with a lawyer. We do our due diligence to identify all sustained damages when approaching the insurance companies and will even go after future damages due to prolonged care and loss of wages.

To ensure you are getting your fair compensation, reach out to an Uber accident attorney in Austell to have your claim evaluated today.

Appearing in Court for an Uber Accident Claim

It is not usually necessary for you to appear in court for accident claims. Claims are often settled outside of court. This is our goal, but there is a chance that the insurance company will not be fair and will not participate in negotiations.

If this is the case, we may be forced to take the claim to the courts. In this event, our attorneys take on all the work of litigating.
