How a Wrong-Way Accident Can Happen
Wrong-way accidents are extreme. They occur when someone is traveling the wrong way on a road or street. A wrong-way accident can seemingly come out of nowhere, and the damages are usually terrible. A personal injury lawyer in Johns Creek will investigate what caused the collision and help recover your losses.
When a driver travels the wrong way, something serious is typically going on. It could be a big lapse in judgment, driver impairment, or some kind of crisis. Sometimes, a lack of visibility or confusion is also the cause.
Common reasons for wrong-way accidents include:
- Drunk driving
- Distracted driving
- Extreme driver fatigue
- Poorly-marked or confusing traffic signs
- Medical crisis
- Driver visibility issues
- Inclement weather conditions
Road conditions can sometimes contribute to a wrong-way accident. For example, confusing signs or damaged traffic signals might make it difficult to know the right way to travel. A two-way road might have a faded center line so that a driver doesn’t realize there are two lanes.
Most wrong-way accidents happen on country roads that are not clearly marked. Drivers are more likely to become confused about the right direction of travel. A driver might also drive too close to the center if they don’t realize there is oncoming traffic.
Many drivers who cause wrong-way accidents are impaired or not in the right condition to drive. But road or weather conditions can contribute to the issue as well. Still, drivers have a duty to be safe on the roads. That includes making sure they travel the correct way and avoid harm.
Establishing Liability in a Wrong-Way Accident
All motorists in Georgia have a duty of care to drive safely. If someone breaches their duty of care, they are responsible for the damages, as stated in the Official Code of Georgia Annotated (OCGA) §51-1-6. If you were injured by the driver’s actions, you can seek compensation for your costs.
The injured party must prove that someone caused the wrong-way accident. Depending on the details, the at-fault party could be:
- A car or truck driver
- Multiple drivers
- A city government
- A construction company
A driver is usually at fault for driving the wrong way. But the government could be responsible for traffic signs that are confusing. A construction company might also be at fault if they removed or blocked important signs.
You and your lawyer will need to investigate the cause of the accident. From there, you can determine who is at fault for the injuries and other damages. If more than one party is liable, you might need to bring several legal cases.
If you or a loved one were hurt in a wrong-way accident, you have legal rights. You can seek compensation for what you’ve lost from the accident. Building Your Car Accident Claim
After a wrong-way accident, it’s best to start building your case immediately. According to OCGA §9-3-33, you typically have two years to bring a case after an injury. If you have a case against a government, you could have as little as six months. If you wait to get started, this takes valuable time away from building your claim.
A legal case takes time and attention to detail. Thankfully, there are ways you can start building your case as soon as possible. When you contact John Foy & Associates, we’ll help you gather the information needed for a successful case. You can also help your situation through the following steps:
- Report the wrong-way accident to the police.
- Take pictures of your injuries, vehicle damage, and the accident scene.
- Get the names and contact information of any eyewitnesses.
- Save all medical bills and other evidence of your damages.
- Get medical attention for your injuries immediately.
Your lawyer can help you gather any evidence you don’t have yet. Again, this is a good reason to speak with a lawyer as soon as possible. They can work to document the scene and your damages while the evidence is still available.
A wrong-way accident lawyer can help your case by:
- Communicating and negotiating with the insurance company
- Gathering additional evidence of your damages
- Making sure you don’t say something that could be used against you
- Calculating all of your accident damages like medical bills, lost wages, and pain and suffering
If you miss the deadline to file your claim, you’ll forfeit any chance of compensation. Protect your rights and learn your options by contacting a legal team today.
