Fatigued Driving Statistics

Fatigued driving is more common (and dangerous) than most people realize:

• According to facts about sleep from the National Sleep Foundation, 36% of drivers have operated their vehicles while drowsy or fallen asleep at the wheel.
• About one in 25 adults have reported falling asleep while driving in the past 30 days, according to drowsy driving statistics from the Centers for Disease Control and Prevention (CDC).
• An estimate from the National Highway Traffic Safety Administration (NHTSA) shows 72,000 accidents, 44,000 injuries, and 800 deaths resulted from fatigued driving in 2013.
• The CDC says these numbers are actually higher with up to 6,000 fatal accidents from drowsy driving each year.

What do sleep deprivation and drinking alcohol have in common? Both can affect your body in similar ways when you’re driving. In fact, according to the National Sleep Foundation, a driver who has been awake for 18 hours without rest has the same impairment as someone with a blood-alcohol level (BAC) of 0.05. This is only slightly below the legal limit of 0.08. A driver who is even more fatigued will be more impaired and unsafe on the road.

The facts above should demonstrate how dangerous driver fatigue can be in Johns Creek. If you were injured in an accident caused by a fatigued driver, you should not have to pay for the costs. Contact a Johns Creek driver fatigue lawyer who can help you build a case and seek compensation.

Why Driver Fatigue Happens

Someone can become fatigued while behind the wheel for a variety of reasons, such as:

• Not getting enough sleep, especially six or fewer hours per night;
• Working long shifts or night shifts;
• Untreated sleep disorders or snoring;
• Medications that cause drowsiness; and
• Alcohol or drug consumption.

Fatigued driving is especially common amongst people who drive for their job, such as truck drivers. Trucking companies put a lot of pressure on drivers to complete routes and move products within a certain period of time. Even though drivers are required to take breaks during and between shifts, that doesn’t always happen.

Car drivers can also experience regular fatigue if they work too long at ridesharing, taxi, or food delivery shifts. Each fatigued driver accident can vary a lot depending on the specific circumstance.

How to Gather Evidence from a Driver Fatigue Accident in Johns Creek

You will need to determine exactly what caused your accident, which requires investigation into the fatigued driver and their negligence. A Johns Creek driver fatigue lawyer can help by:

• Looking at driver logbooks and driving histories;
• Talking to the driver’s employer;
• Pulling traffic camera footage to show if the driver was swerving or showing other signs of impairment;
• Talk to any witnesses you might have witnessed fatigued behavior; and
• Find any other evidence that can be used to support your claim.

You can also help your case by taking pictures at the scene, talking to the driver, reporting any fatigued, drowsy, or impaired behavior to the police, and keeping track of all medical bills, missed workdays, and other evidence of your damages.

If the fatigued driver directly caused your accident, they may be fully responsible for your damages. Your lawyer can investigate and determine your legal options while helping you build a case.

A Lawyer Can Handle the Insurance Company

To seek compensation for your damages, you’ll need to file a personal injury claim against the driver and their insurance company. This is where things can get complicated and frustrating.

Insurance companies are not on your side. The at-fault driver’s insurer will likely spring into action after your accident, looking for ways to reduce the value of your claim. They might use tactics like:

• Offering you a lowball settlement upfront;
• Calling you and getting information that can be used against you later;
• Downplaying or questioning the severity of your injuries;
• Trying to blame you for the accident; or
• Telling you that you don’t need a lawyer to settle your case.

Before you sign anything or accept any settlement offer from the insurance company, contact an experienced injury lawyer. Insurance companies are skilled at taking advantage of accident victims, and they do not have your best interest at heart—even if they seem nice and friendly.

Your lawyer can communicate with the insurance company on your behalf. If you get a lowball settlement, they will work to negotiate for an offer that is actually fair to you. Your lawyer will also be able to calculate the full value of your damages so you know what type of settlement actually covers your costs.
