What It Means to Be an Aggressive Driver in Johns Creek
Under Georgia Code § 40-6-397, aggressive driving refers to the act of operating a vehicle “with the intent to annoy, harass, molest, intimidate, injure, or obstruct another person.” Aggressive driving can also include violating laws related to passing, driving on the right side of the road, following too closely, turning, changing lanes, and more.
A driver who is convicted of aggressive driving will face a misdemeanor of a high and aggravated nature. Aggressive driving is a significant traffic offense that can cause serious and even fatal accidents.
Types of Aggressive Driving Behavior
There is a wide variety of behaviors that fall under the definition of aggressive driving. Examples may include:
- Running a stop sign or red light;
- Using a vehicle to race with other vehicles;
- Greatly exceeding the speed limit;
- Swerving in and out of lanes without warning;
- Following another vehicle too closely (also known as tailgating);
- Slamming on the brakes in front of another vehicle; and
- Using offensive hand gestures, yelling, or brandishing a weapon at other drivers.
That last example describes road rage behaviors. Aggressive driving can easily and quickly lead to road rage, which is when a driver uses their vehicle as a weapon against someone else.
Both aggressive driving and road rage are incredibly dangerous to everyone on Johns Creek roads, and the consequences can be terrible. That’s why, if you were hurt or a loved one was killed in an aggressive driving accident, you have rights.

- Organ damage; and
- Burns and lacerations
These injuries can leave you with huge medical bills, days or months or missed work, emotional damages, and much more. You Have Two Years to File Your Claim in Georgia
The statute of limitations for car accident cases in Georgia is two years (Georgia Code § 9-3-33). That’s the amount of time you have to file your claim, and it’s important not to waste it.
You will need sufficient time to go over the details of your accident with your lawyer, investigate the accident, gather evidence for your case, and deal with the insurance company. Your lawyer can handle these details for you, so the best first step is to reach out to a trusted professional.

What to Do If You Were Injured in an Aggressive Driving Accident
Although an experienced lawyer will give you the best chance of successful compensation, there are also things you can do (and should do, if it’s possible) after the accident to help build your case.
Report the Aggressive Driving Accident
Any car accident with injuries that happens in Johns Creek should be reported to the police. Call 911 to report the accident, and make sure officers know that the other driver was being aggressive.
If you feel unsafe around the other driver after the accident, stay inside your vehicle when you call to report the crash. If you can safely get pictures or a video of the driver’s behavior, it can be helpful to your case, as well.
Take Pictures
Besides documenting the other driver’s behavior, you can also use your phone or a camera to snap pictures of:
- Your injuries;
- Your vehicle damage;
- The entire accident scene; and
- Anything else that might help show what happened.
Pictures help preserve the scene so there is no question about how it looked right after the crash occurred.
Talk to Witnesses
If anyone else saw the accident happen, talk to them and ask for their information. They might be helpful in providing witness statements to support your case. Talk to your lawyer about this.
Get Medical Attention
If you have injuries that appear serious or life-threatening, call for emergency medical attention at the scene. Otherwise, be sure to see a doctor as soon as possible after you leave the scene.
If you wait too long to get medical treatment, the aggressive driver’s insurance company might try to say you were not hurt as badly as you say or that your treatment costs were not related to this accident. So, don’t wait to get checked out.
Talk to an Aggressive Driving Accident Lawyer
Your Johns Creek lawyer can help you:
- Gather further information about the accident;
- Communicate and negotiate with the insurance company;
- Build a strong insurance claim; and
- Determine what a fair settlement for your damages actually looks like.
Without a lawyer, you risk missing out on the full compensation you deserve. Research has shown injury victims who work with an attorney or much more likely to receive a higher settlement.
