Your Options After a Rental Car Accident
A rental car accident claim depends on several details. First of all, it’s important to know who caused the accident. Our personal injury lawyers in Johns Creek will investigate the collision and determine what caused it.
In Georgia, the at-fault party in an accident is responsible for the damages. An injury victim can seek compensation through the at-fault driver’s insurance company.
When You Were Driving the Rental Car
There are a few scenarios that can happen with a rental car accident. In one, you were driving a rental car when another driver hit you. If the other driver was at fault, you would then file a claim with their insurance company.
Unless the other driver was also in a rental, this situation is the simplest. You usually only have to deal with one insurance company for your claim. However, you’ll still need to fight for the full compensation you deserve.
When a Rental Driver Is At Fault
In the other scenario, the at-fault driver was operating a rental car when they hit you. Since the rental car driver caused the accident, they are liable. But the insurance side of things is more complicated.
You will need to find out which insurance covers the accident. If the driver bought insurance through the rental company, that insurance company should pay. You can usually file a claim with the insurer for compensation.
If the driver did not buy insurance through the rental company, they are relying on their own insurance. You would need to file a claim with the driver’s personal insurance company. The driver’s credit card company might also provide coverage, so you might have to file several claims.
Uninsured Rental Car Accident Coverage
Rental car companies should not rent cars without insurance. If the renter denies the extra coverage, they should still carry their own insurance. However, some renters lie about their coverage or don’t realize their policy has lapsed.
If there is no insurance coverage, you might need to turn to your own insurance. If you have an uninsured motorist policy, you can seek compensation through that policy. Talk to a Johns Creek rental car accident lawyer if you have questions.
Damages to Claim After a Rental Car Accident
A rental car accident can affect your life in many ways. Keep track of all costs and losses from the crash. You’ll need to provide proof of each in your insurance claim.
Common car accident damages include:
- Medical bills
- Medication costs
- Lost wages
- Loss of earning capacity
- Vehicle repair costs
- Pain and suffering
- Mental anguish
It’s important to know all of your accident damages before filing a claim. That includes future medical treatment you might need long after the accident. To make sure you’ve considered all losses, contact an experienced lawyer for help.

What to Do After a Rental Car Accident
A rental car accident happens suddenly. No one is prepared for this type of crash, and it can be a very stressful experience. However, it’s important to stay calm and gather as much information as you can.
After the accident, the following steps can help you build your claim:
- Call the police to report the accident. Make sure officers create an accident report on the crash. Ask how you can get a copy of this report for your records.
- Get medical treatment as soon as possible. If you need emergency medical attention, call 9-1-1 immediately. Otherwise, see a doctor as quickly as you can after the crash. You’ll want to document all doctor appointments and treatment for your claim.
- Gather information at the scene, including pictures, the other driver’s information, and witness contact information. Save all evidence you can from the accident scene.
- Call the rental car company. The company will need to know that you got into an accident, especially if you purchased insurance through them. If you didn’t have rental insurance, let your own insurer know about the accident.
- Document your damages, such as medical bills and lost income. Save all bills and receipts to use as proof in your claim.
Talk to a rental car accident lawyer in Johns Creek for help with all of the above. According to the Official Code of Georgia Annotated (OCGA) §9-3-33, you must bring a case within two years of the date of your accident. In some cases, you have even less time.
