What Is the First Thing I Should Do After an Accident in Lilburn?
What you do after an accident can impact your case. Here are some things you can do afterward to protect your rights and help build a strong insurance claim.
See a Doctor
Your well-being and getting treatment for any injuries is a top priority after an accident. Whether you were in a car accident or other auto accident, slip and fall accident, suffered a dog bite, or something else, you should get checked out by a medical professional. This is crucial for your insurance claim.
See a doctor if you aren’t in much pain or your injuries seem minor—and definitely, do so if you’re seriously hurt. You never know how your body will respond in the hours and days after an accident. Some injuries worsen with time or aren’t apparent until after the adrenaline has worn off. You want to account for any and all medical costs, now and in the future, that result from your personal injury accident, so see a doctor as soon as you can.
Report the Accident
Besides getting medical attention, you’ll also want to call the police and report the accident. Officers may come to the scene and collect information from those involved in the accident. For example, if you’re in a car accident, police will ask for the driver’s license number and insurance information from both you and the other driver(s).
When you report the accident, a police report will be created as a record of what happened. You will need this for your personal injury claim. It helps prove the accident happened.
Gather Evidence
Many injury victims don’t realize they can help preserve evidence from their accident. If you’re well enough to stay at the scene and don’t need emergency medical attention, you can use your phone to take pictures of what happened, including:
- The accident scene
- Your injuries
- The injuries of anyone else involved, such as your car passengers
- Vehicle damage or other property damage
You can also speak to anyone who saw the accident happen and ask for their contact information. Your personal injury lawyer can use this evidence when working on your case.
Don’t Sign Anything
It’s very common after a personal injury accident for the at-fault person’s insurance company to contact the injured person. The insurer may reach out to you and offer you money upfront, asking you to sign paperwork confirming it. They are hoping this tempts you to take the offer and move on, but it’s deceiving.
If you accept a settlement, you’ll lose your chance at a higher amount—and the upfront offer is way less than you deserve. Instead, you should calculate all of your damages first so you know what your costs will be. A personal injury lawyer can help you with this and every step of the process.
Contact a Lilburn Personal Injury Lawyer
An experienced personal injury lawyer in your area will have years of experience working with people injured in accidents like yours. They know how to handle insurance companies and how to negotiate for a fair dollar amount.
Most personal injury lawyers like John Foy & Associates offer a free consultation where they will analyze your situation and let you know if your case is strong. A good attorney can also help you gather the right evidence and call on any experts needed to support your claim. This is the best thing you can do to pursue a fair settlement after your accident.
What Is an Average Settlement for a Lilburn Personal Injury Claim?
This is actually a difficult question to answer because it varies widely. According to survey results from Lawyers.com, the average reported settlement was almost $53,000 with settlements ranging anywhere from $3,000 to $75,000 and sometimes more. It’s best to contact a personal injury lawyer directly with questions about your own case, however, as it really depends on the details.
Your settlement potential will depend on your damages and sometimes other details of your case. But the biggest factor in what you can receive for your claim is the nature and severity of your injuries.
The more serious your injuries are, the higher your costs will be. You’ll face more expenses related to things like:
- medical bills (current and future) from treatment, prescriptions, doctor visits, etc
- lost wages from missed work time during treatment
- general damages related to physical or mental pain and suffering like loss of enjoyment of life, anxiety and depression, fear, or humiliation
This means the total value of your claim will go up based on what you’re losing because of the accident.
Another possible factor is the insurance limits. If your damages exceed policy limits, the insurance company won’t offer anything above those limits.
Most successful personal injury claims are settled outside of court without the need to go to trial, although there are exceptions. Hiring a personal injury lawyer can also have a huge impact on the outcome of a claim. On average, injured individuals receive settlements in the higher ranges if they work with a lawyer versus file the claim alone.
