Like tractor-trailers, buses are large, heavy, and hard to maneuver. They are prone to rollover accidents and can cause tremendous damage when they collide with other vehicles. Both passengers and other motorists are in danger when a bus driver loses control.
Speak with our Lilburn personal injury lawyer today for more information about your claim.
If you or a loved one has been injured in a collision involving a bus in the northeastern Georgia area, you need the advice of a Lilburn bus accident lawyer from John Foy & Associates. You may suffer injuries and property damage that result in substantial bills because of someone else’s negligence. Our professional legal team is ready to guide you.
Bus Accidents Are Extremely Dangerous
Public transit and school buses are most often involved in these kinds of crashes, according to the Federal Motor Carrier Safety Administration (FMCSA). School buses make up 39% of accidents, and transit buses were part of 34% of collisions over a 10-year period. Victims can be involved in t-bone, sideswipe, and head-on crashes, causing severe injuries or even death.
As a passenger, you could be thrown around the cabin of the bus since most buses do not have seatbelts. Corrosive or flammable fluids could burn your skin or blind you. If your vehicle is hit by a bus, the weight and mass can destroy your car and leave you with catastrophic injuries.
When a school bus is involved, it means the lives of children can be changed forever. If your child has been hurt, you face the possibility of lifelong medical treatment for them. No matter what the circumstances of your bus accident are, you need compensation for potentially astronomical medical bills from the person who is to blame.
What Is a Lilburn Bus Accident Claim Worth?
Transit and school buses can affect other motorists and pedestrians, injuring many people at once when they crash. Sorting out who is at fault for your injuries can be difficult. Once you and your bus accident attorney in Lilburn have identified who is to blame, you can proceed with seeking damages from them.
Economic vs. Non-Economic Damages
Most victims will pursue damages in two categories: economic and non-economic. Economic losses are those with a specific price tag, while non-economic damages address how the accident affects your life. Regardless of how high your losses are, you deserve a fair and appropriate settlement to ensure you are not left facing unpaid bills.
Some examples of the kinds of damages you may claim include:
-
Economic:
- Past and present doctor bills
- Money to cover future medical costs
- Loss of income
- Emergency transport expenses
- Travel costs for treatment
- Surgery, ER, and ICU bills
- Property damage to your car or other personal items
- Medications
- Medical devices
- Renovations to your home to accommodate a disability
-
Non-Economic:
- Mental anguish
- Scarring
- Disfigurement
- Amputation
- Loss of consortium with your partner
- Loss of care and guidance for your children
- Pain and suffering
- Loss of enjoyment of life
- Mood disorders such as anxiety, depression, or PTSD
If you proceed to a jury trial, the judge may elect to award punitive damages. These are meant to punish the defendant harshly and set an example for other companies or individuals. Punitive damages are awarded when the actions that caused the accident were grossly negligent or malicious in nature.
How a Lilburn Bus Accident Attorney Can Help You
No matter how severe your injuries are, you need to concentrate on getting better, not worrying about bills piling up. Fighting to get your claim paid by insurance or through litigation can be exhausting. Hiring a skilled bus accident attorney in Lilburn from John Foy & Associates can make it easier for you to heal.
We handle the paperwork and negotiations so you and your family can recover. Our team will work to build your case by gathering evidence such as:
- Accident scene investigation reports
- Photos and video of the scene and your injuries
- Medical records
- Expert testimony for your prognosis
- Police reports
- Witness statements
- Cell phone records
- Event Data Recorder (EDR) or “black box” information from the bus (if available)
While many injuries are treated on the scene or in the hospital right after the crash, some may not appear until days or weeks later. If you suffer a back or muscle injury, it could affect your movement for a long time. Your attorney can help you find doctors who specialize in your injuries and ensure you have a full diagnosis.
How You Can Help Your Case
You can help your lawyer help you by following some recommendations to protect your claim and build the strongest case possible:
- Track your expenses and receipts.
- Follow your doctor’s orders.
- Keep all your medical appointments.
- Take all recommended medication.
- Attend all therapy sessions.
- Keep a journal of your pain and experiences.
- Share your receipts and journal with your lawyer.
- Let your attorney speak to insurance representatives or other lawyers.
- Limit conversations about the accident with family and friends.
- Do not post on social media about the accident.
- Tell family and friends not to post on social media.
Your lawyer will also negotiate with insurance companies to protect you from lowball offers. Insurance adjusters want you to take an insufficient offer quickly so they can close the claim. However, you must wait until you have a full estimate of the compensation you will require to fully recover.
