Understanding USPS Workers’ Compensation Claims
If you work for the United States Postal Service and you get hurt on the job, you’re covered under a federal workers’ compensation program called the Federal Employees’ Compensation Act (FECA).
This system is different from Georgia’s state workers’ compensation program, so the rules can be confusing.
Here are some basics you should know:
- You don’t need to prove fault. You just need to show your injury happened while doing your job.
- You’ll work through the Office of Workers’ Compensation Programs (OWCP) instead of a state agency.
- You must follow specific steps and deadlines to avoid delays or denials.
A Warner Robins postal worker injury lawyer from our team will manage the process for you, ensuring we check for everything and protect your rights.
What Does Workers’ Compensation Cover?
Workers’ compensation for USPS employees can help with:
- Medical treatment: Doctor’s visits, surgeries, medications, therapy, and more
- Lost income: A portion of your paycheck while you can’t work
- Job retraining: If you can’t return to your old position
- Permanent disability: If you’ve suffered permanent injuries
- Death benefits: For surviving family members if a relative died due to a work injury
If you lost a loved one while they were working for USPS, we know this kind of loss can’t be fixed with money. However, these benefits can help ease the financial burden while you grieve. Our Warner Robins USPS work injury lawyers are here to support families just like yours.

What if USPS Denies a Workers’ Compensation Claim?
Unfortunately, many USPS workers get denied the first time they file a claim. This might happen because of:
- Missing paperwork
- Not enough medical evidence
- Mistakes in the forms
- Missed deadlines
While a denial isn’t the result you want, it doesn’t mean the end of your efforts to recover benefits. Our Warner Robins USPS workers’ comp claim attorneys know how to appeal and fight for what’s fair.
We’ll help gather documents, work with your doctors, and push back if the government does not grant you your benefits.
Can USPS Workers File Third-Party Claims?
U.S. postal workers can file a third-party claim, but only in certain situations. If someone outside of the federal government caused the injury, the worker may be allowed to file a third-party personal injury claim against that person or business.
Examples of When a Third-Party Claim May Apply
- A mail carrier is hit by a distracted driver while delivering mail.
- A postal worker slips and falls on unsafe steps at a private residence or business.
- A dog attack happens while delivering mail, and the dog owner fails to secure the animal.
In these cases, injured USPS workers can:
- Receive workers’ compensation benefits through FECA and
- Pursue a third-party lawsuit for additional damages, like full lost income, pain and suffering, or other losses that FECA does not cover.
However, the government may have a right to recover some of the workers’ comp payments from any third-party settlement. This is called subrogation. We will advise if you have a valid third-party claim and ensure all parties handle your case the right way.
How Long Do I Have to File a Workers’ Comp Claim?
In these cases, time matters. You generally must:
- Report your injury right away (preferably on the same day that it happened)
- File Form CA-1 or CA-2, depending on the injury type
- Follow OWCP deadlines (usually within three years of the injury, per 5 U.S. Code § 8122)
We advise that you don‘t wait. The sooner you get legal help, the stronger your case will be. Our USPS worker injury lawyers in Warner Robins can make sure we file all paperwork properly from the start.
Who Can Pursue Damages After a Fatal USPS Work Injury?
If a USPS worker dies from a job-related accident or illness, surviving family members may be entitled to:
- Funeral and burial expenses
- Ongoing benefits for a surviving spouse and children
- Back pay or unpaid medical bills owed at the time of death
We know you may be dealing with shock, sadness, and financial strain. Our Warner Robins fatal USPS injury lawyers can take on the legal stress so you can focus on healing.
