What You Should Know About the Federal Employees’ Compensation Act (FECA) as a USPS Worker
The Federal Employees’ Compensation Act (FECA) was established in 1916, and it governs workers’ compensation claims for federal employees. This includes people who work for the USPS.
State governments oversee state-level workers’ compensation programs. However, FECA is administered at the federal level by the U.S. Department of Labor (DOL) through the Office of Workers’ Compensation Programs (OWCP).
This is why your Athens personal injury lawyer will make sure you follow federal guidelines when filing a claim for a work-related injury or illness. Under FECA, you might be entitled to a variety of benefits:
- Medical treatment
- Wage replacement
- Rehabilitation services
However, the process for filing a claim and determining your eligibility for benefits is different from Georgia’s state workers’ compensation laws. There are certain procedures that must be followed.
With USPS workers’ compensation claims attorneys in Athens by your side, your lawyer will ensure that your claim is filed accurately and on time.
Types of Benefits Under FECA
USPS workers who are injured on the clock are eligible for several types of benefits. However, the specific benefits that you can expect to receive will depend on the nature and severity of your injuries.
In general, here are the primary benefits available to USPS workers under FECA.
Medical Benefits
USPS workers are often entitled to medical treatment related to their injuries, including doctor visits, surgical procedures, prescription medications, hospital stays, and physical therapy.
The OWCP pays for these medical expenses, allowing the injured worker to receive care without incurring out-of-pocket costs.
It is important to note that only certain authorized medical providers may be used for treatment under FECA, so injured workers must follow specific guidelines when seeking care.
Wage Replacement Benefits
If the injury results in lost wages, the injured USPS worker is usually entitled to wage replacement benefits. For temporary disabilities, workers generally receive two-thirds of their regular wages while they are unable to work.
Meanwhile, in the face of permanent disabilities, these benefits may continue indefinitely. However, it all depends on the severity of the injuries.
Vocational Rehabilitation
In cases where an injury prevents the USPS worker from returning to their previous job, vocational rehabilitation may be provided. This includes services designed to help the worker acquire new skills or retrain for a different job that accommodates their injury.
The goal of vocational rehabilitation is to ensure that injured workers can return to gainful employment, even if they cannot continue with their original job duties.
Death Benefits
In the unfortunate event that a USPS worker dies as a result of a workplace injury, their surviving family members may be entitled to death benefits.
These benefits are intended to provide financial support to the worker’s spouse, children, or other dependents. That said, the monetary value of the benefits depends on the deceased worker’s wages and the number of dependents.
Important Time Limits for Filing Claims
For USPS workers, it is very important to understand the time limits for filing a workers’ compensation claim under FECA. There are strict deadlines that you must adhere to when reporting injuries and submitting claims.
Failure to adhere to these deadlines can result in the complete denial of benefits, and you could lose your right to seek financial compensation altogether. But how much time do you have? Generally speaking, USPS workers must report an injury within 30 days of the incident.
From there, they must file within three years. To make sure you meet all deadlines that apply in your case, reach out to an Athens USPS workers’ compensation claims law firm as soon as possible. Your legal counsel will ensure that you submit everything on time.
