Comparative Negligence for Lyft Accidents in Valdosta
Comparative negligence refers to the rules outlined in the Official Code of Georgia Annotated (OCGA) § 51-12-33. What comparative negligence (sometimes also called comparative fault) refers to is the importance of how much each party involved in the accident was at fault. This also includes your liability.
Even though you’re not the driver of a Lyft, that doesn’t mean that the at-fault party or the insurance company won’t try to find some way to pin the blame on you. Remember, if you’re more than 50% responsible for your accident, you can’t file a claim for a settlement. In other words, you’ll end up dealing with the full costs of your damages.
This is why it’s extremely critical that you have a strong case to back the claim you file. Doing so alone is notoriously difficult. Hiring a lawyer is in your best interest to fight hard for a settlement that covers all your damages. Don’t underestimate just how much a strong lawyer can do for you.
How Our Lyft Accident Lawyers in Valdosta Can Assist
Many Lyft accident victims are skeptical to hire a lawyer because they assume that Lyft or the insurance company will do the right thing and pay for their damages easily. While this is the best-case scenario, it hardly ever is the case. Our lawyers can help you fight for your claim in many ways.
Collecting Evidence and Building a Strong Case
As we stated previously, the importance of having evidence to prove fault is essential for building a strong case. The stronger the case you have, the better chances you have at getting financially compensated.
We can help you collect essential documents, witness testimonies, and other physical evidence related to your accident to prove your damages and negligence of the at-fault party.
Representing Your Best Interests at All Times
Our Valdosta Lyft accident lawyers know exactly how to handle large businesses and insurance companies. We can ensure the integrity of your claim doesn’t get compromised and put your best interests forward at all times, even above our own. In addition, we won’t hesitate to take your claim to trial if we have to.
Calculating Your Damages
Calculating the damages you suffered accurately is a lot more difficult than it seems. A lot of Lyft accident victims tend to undervalue their damages, which only works in the insurance company’s favor. Our lawyers will review your entire case and ensure that your settlement accurately represents the true amount of damages you sustained.
Damages You Can Recover After a Lyft Accident
You can receive compensation for several damages related to your Lyft accident, such as:
- Pain and suffering
- Mental anguish
- Loss of enjoyment of life
- Loss of consortium
- Wrongful death
- Lost wages
- Property damages
- Medical expenses
- Disability or disfigurement
Never let the insurance company try to claim you’re overexaggerating or that your damages aren’t as bad as they seem. Instead, we will negotiate for a settlement that gets you fairly compensated. As long as the damages you suffered are directly linked to your Lyft accident, you can factor them into your settlement.

Punitive Damages in Lyft Accident Claims
While not available for every Lyft accident, OCGA § 51-12-5.1 allows for certain Lyft accident victims to receive an award for punitive damages. Punitive damages aren’t compensatory. Instead, they act as punishment for the at-fault party based on several factors:
- Egregious negligence, such as DUI
- Committing a crime while they caused an accident
- Intentionally trying to cause harm to you or other people
If your case can qualify for punitive damages rewards, rest assured that our Lyft accident lawyers in Valdosta will do everything they can to get it for you on top of your settlement.
Georgia’s Statute of Limitations for Lyft Accident Claims
The statute of limitations for Lyft accidents in Valdosta is only two years. In other words, there is a two-year deadline to file a claim against the at-fault party responsible for your Lyft accident. If this deadline passes, there’s next to nothing you can do to win a settlement. Therefore, don’t sit on your claim for too long. Take prompt action right away after receiving medical treatment.
