What to Do After a Rideshare Accident in Woodstock, GA
Upon being involved in a rideshare accident, there are several critical steps that you should follow to protect your legal rights and position your future rideshare accident claim for a successful outcome. These steps are:
Call the Police
As with any car accident, you must call the police immediately so that they can come to produce a police report. This ensures that there is relevant documentation available to support your eventual claim. Having a police report created gives you an essential resource that can be used during negotiations to prove the known circumstances of the accident.
Speak to Witnesses
If there are people who witnessed the accident, you should try to get them to provide a written statement to the responding police officer. Witness testimony can be a critical piece of evidence in the hands of your legal team. So, make sure you always engage with people who saw the accident to see if they are willing to provide you with their testimony for later use.
Take Pictures of the Accident Scene
When possible, take pictures of the accident scene. It is important to get pictures of any involved vehicles, nearby traffic signs, and any injuries you or other passengers suffered. Taking pictures that convey road conditions can also help you in the process of building your case.
Seek Medical Attention
If you were injured in a rideshare accident, you need to seek medical attention immediately. This ensures that when you file your rideshare accident claim, you have proof of your injuries. You need this evidence to have your medical bills covered, so do not wait to go to the hospital. If you do, the liable party may try to claim that your injuries were not caused in the accident you are making a claim for.
Waiting weeks or months to seek medical care may even lead to the insurance company denying your claim altogether. Even if the carrier does not deny the claim, they could instead attempt to only pay a portion of your medical expenses. Worse yet, waiting to get medical attention gives them the opportunity to diminish your pain and suffering because they have proof that you were not in enough pain to seek medical care immediately.
Speak to a Woodstock Lyft Accident Lawyer
When you become the victim of someone else’s negligent behavior, hiring a lawyer is always the best course of action. Legal representation can guide you through the process of claiming compensation and help you build the strongest possible case against the at-fault party. With a lawyer on your side, you gain access to legal knowledge and insights that are often unattainable for someone outside of the legal profession.
Rideshare Passenger Rights
A Woodstock Lyft accident lawyer will work hard to protect your rights. To achieve this, they will conduct a detailed investigation into the accident and make every possible attempt to preserve relevant evidence. In doing so, they position your case for a positive outcome making it more likely that your rights will be upheld.
Fortunately, some rideshare accidents are covered by the rideshare company’s insurance. For example, both Uber and Lyft carry insurance policies that offer up to $1 million in liability coverage for drivers who are currently transporting passengers. Though, this coverage only applies if the accident is caused by the rideshare driver.
If the driver did not cause the crash, liability will fall on the at-fault driver in most cases. But rideshare accidents are very complex, and there are numerous potential liable parties in most cases. Therefore, it makes sense to have a Woodstock Lyft accident lawyer sort through the details of your case and help you file your claim.
Types of Compensation Available for Rideshare Accident Claims
If a rideshare accident caused significant injury to your person or property, the responsibility for the related damages should not fall on you. Rather, you deserve compensation from whoever was liable for the accident. Usually, rideshare accidents involve filing a claim against the liable party’s insurer, but it depends.
Regardless of who is paying, you need to know what types of compensation are available to you. These are some examples of compensation that could be recovered through your rideshare accident claim:
Economic Damages
Economic damages refer to compensation made for objectively verifiable monetary losses. Here are some examples of economic damages:
- Lost earnings associated with an injury
- Past and future medical expenses
- Lost business opportunities
- Property damage
Non-Economic Damages
Non-economic damages are any damages that are deemed unmeasurable. This does not mean they do not have value. Instead, non-economic damages simply cannot be calculated by adding up bills or other quantifiable costs. Generally, these are non-monetary and difficult to quantify by typical means. Here are some examples of non-economic damages:
- The injury itself
- Emotional distress
- Disability or disfigurement
- Pain and suffering
- Physical impairment
- Loss of companionship
- Loss related to the plaintiff’s reputation
- Loss of enjoyment of life
