Who Is Liable for a Lyft Accident?
If you are a victim of a collision involving any ridesharing company, including Lyft, you might be wondering who is liable for your injuries. Ridesharing companies often have insurance policies that may cover property damage and physical injuries. However, there are incidences where a Lyft driver may be held liable for negligence.
While ridesharing companies require their drivers to have a clean driving record and carry personal insurance, they consider their drivers as independent contractors. Therefore, the rideshare company may not always take responsibility for its drivers’ conduct.
For example, a Lyft driver who gets into an accident while their app is inactive or off may be held personally liable for property damage or injuries sustained from a crash. But if the app was active and the driver had accepted a passenger, Lyft Company may be held liable if an accident occurs. All these rules and policies can be very hard to follow, and seeking legal help from an experienced personal injury lawyer in Roswell might be the best way to determine who is at fault.
Don’t Speak with the Insurance Company – Call a Roswell Lyft Accident Lawyer First
Roswell Lyft accident attorneys advise accident victims to avoid making any statement to either the insurance company or police before reaching out for a consultation to know more about where they stand legally. This is because insurance adjusters often try to reduce claims to ensure companies maintain their bottom lines.
Chances are, if you speak with the insurance company without first talking to a lawyer, you may unwittingly say something incriminating or that might lower your total financial damages award.
Suing for a Lyft Accident in Roswell
If you are not the person at fault during a Lyft collision, this means that you had no role in causing damages or your own injury, and someone else is to blame for their negligent or reckless actions. Injuries can range in severity, and if you have medical bills and other expenses after the Lyft accident, you should not be responsible for covering these costs; rather, the insurer of the negligent party should compensate you.
The monetary compensation you may get can cater to the past and the current costs that you face due to the collision. It can also help you cover any future expenses that may arise due to the injuries. If you lost your source of income, the financial compensation could greatly improve your and your family after a Lyft accident.
However, you need to take legal action to ensure the liable party compensates you. But the legal process is challenging unless you have an experienced attorney to represent your case. Without a Lyft accident lawyer in Roswell, you may lose your case or receive an amount less than what you rightfully deserve.
