• Disobeying traffic signs and signals

Aggressive driving is a significant factor in many car accidents in Stonecrest. Aggressive drivers can cause severe or fatal accidents. If a driver was at fault for your crash, you have a right to seek compensation.

Your Legal Rights After an Aggressive Driving Accident

Aggressive driving is a hazardous activity that puts everyone on the road at risk. In Georgia, all motorists have a duty to drive safely. Aggressive driving is a direct violation of that duty.

If you were injured because of an aggressive driver, you might deserve financial compensation. According to the Official Code of Georgia Annotated (OCGA) §51-1-6, you have a right to recover damages if someone breaches their duty to you.

Before you can recover damages, you need to build a personal injury claim. Most of the time, you can file a claim with the at-fault driver’s insurance company. Your claim must prove that:

• The other driver owed you a duty of reasonable care
• The driver breached their duty of care
• You were injured because of the breached duty
• You suffered damages because of your injuries

If you have a strong claim, you might be able to recover your accident costs fully. It can be challenging to prove fault, but an experienced lawyer can help. It’s best to contact an aggressive driving accident lawyer as soon as possible.

Aggressive Driving Accident Damages

A car accident can leave a victim with many damages. When someone causes an accident, the law allows you to recover what you’ve lost, including:

• Medical bills
• Medication costs
• Rehabilitation costs
• Lost income
• Loss of future income
• Vehicle damage expenses
• Pain and suffering
• Emotional distress

There are both economic and non-economic damages. Each accident is different, but victims typically have both types of losses. Your lawyer can determine your total damages from the accident.

Georgia also has modified comparative fault laws. According to these laws, you can recover damages if you were less than 50% at fault. Even if you were partially responsible for an accident, you might still deserve compensation. Your percentage of fault would reduce your damages by the same degree.

John Foy & Associates can determine the fault and damages in your accident. Contact us today to go over the details during a FREE consultation. Call (404) 400-4000 or contact us online.

Aggressive Driving vs. Road Rage

Aggressive driving is very reckless behavior. If the driver’s conduct escalates, it can become road rage.

While aggressive driving is a traffic offense, road rage is a crime. Road rage means using a vehicle as a weapon against other drivers.

Unfortunately, aggressive driving can turn into road rage very quickly. Signs of road rage include:

• Tailgating another vehicle and flashing headlights
• Stopping and going suddenly around other drivers
• Slamming on the brakes in front of other drivers
• Yelling at other drivers
• Driving swiftly in and out of lanes
• Brandishing a weapon towards other motorists
• Making rude or insulting hand gestures towards other drivers

Aggressive driving and road rage can be incredibly dangerous. They can cause severe injuries or even death. If you or a loved one were injured, you have rights.

You will need to show that the driver’s actions led to your accident. You’ll also need to prove your damages from the crash. An experienced lawyer can help you do this and more.

What to Do After an Aggressive Driving Accident

After an accident, you’ll need to document the details. You and your lawyer can gather evidence to show what happened after the crash. Here are some steps you can take to build your claim.

Report the Accident

Always report an accident with injuries to the police. Call 9-1-1 and wait for officers to arrive at the scene. Tell the police about any aggressive behavior from the other driver.

Also, stay safe while waiting for the police. If the other driver could be dangerous, stay in your car. Do not confront the driver or try to escalate the situation.

Officers should create a crash report on the accident. This is crucial because it’s the first official record of the accident. You’ll need to get a copy of this report.

Document the Scene

Record the scene as fully as possible. Take pictures of:

• Your injuries
• All vehicle damage
• The entire accident scene

A car accident scene can change quickly. But pictures preserve the details forever. These pictures can be invaluable for your accident claim.

Record Your Damages

After the accident, see a doctor as soon as possible. You will need records of your medical treatment. Also, save all other evidence of your accident-related costs.

Be Careful What You Say

Avoid admitting any blame for the accident. Do not discuss the crash with the other driver or their insurance company. Wait until you have a lawyer who can help you.

Insurance companies will look for ways to reduce their costs after an accident. That means using something you’ve said against you. You can protect your rights by letting a personal injury lawyer handle the legal details.
