Causes of Taxicab Accidents in Stonecrest
Taxicabs provide rides for residents and visitors in Stonecrest. While many cab drivers are experienced and well-trained, accidents can still happen. Taxicab drivers can be aggressive, especially during heavy traffic.
A taxi accident can happen because the cab driver was negligent. Other times, another driver might be at fault. Either way, the accident can happen because of actions like:
- Excessive speeding
- Unsafe lane changes
- Failing to yield the right-of-way
- Driving under the influence (DUI)
- Distracted driving
- Aggressive driving
- Running red lights
- Driving while fatigued
Driver carelessness is often the cause of a taxicab crash. However, other reasons might include:
- Defective vehicle parts
- Poor vehicle maintenance
- Dangerous road or weather conditions
- Inadequate driver training
Partial Fault in a Taxicab Accident
Georgia is a fault state, meaning the at-fault driver is liable for the costs. More than one party might be at fault for a taxi accident. In that case, you could have more than one accident claim.
According to the Official Code of Georgia Annotated (OCGA) §51-12-33, an accident victim can recover damages if they were less than 50% at fault. If a victim is partially at fault, the courts would reduce their compensation by their fault percentage.
Talk to a lawyer if you’re worried about being partly at fault. Do not admit any blame without consulting a lawyer about your accident first. Your attorney can evaluate the accident and uncover the truth. Many injury victims find that they hold no fault for the accident that harmed them.
Determining Fault in a Taxicab Accident
After a taxicab accident, you might wonder who is responsible: the cab driver or the taxicab company? The answer is that it depends.
Many cab drivers are independent contractors instead of employees. When a driver is a contractor, they have fewer protections than employees. If an accident happens, the driver could be personally responsible.
You usually cannot sue a taxicab company if the driver is a contractor. However, the company may be responsible if the driver was an employee. It’s best to speak with a Stonecrest taxicab accident lawyer who can investigate.
When the Taxicab Company Is at Fault
The taxi company might be responsible if:
- The company did not keep up with taxicab maintenance
- The company failed to hire or train drivers properly
Talk to an experienced lawyer if you suspect either of the above. You might have a claim against the driver, taxicab company, or both. At John Foy & Associates, we can help determine who is liable.

Taxicab Accident Injuries
Taxicab accidents can range from minor to severe. No matter the severity, someone might be liable for your injuries.
After an accident, always get medical attention for your injuries. Even if you feel okay, you could have injuries that worsen with time. Also, seeing a doctor will create a record of you getting treatment after the accident.
Common injuries from taxi accidents include:
- Whiplash
- Back and shoulder injuries
- Broken bones
- Traumatic brain injuries (TBI)
- Spinal cord injuries
- Strains or sprains
- Severe burns
- Cuts and bruises
You could suffer injuries as a passenger, pedestrian, or another driver. No matter your role, you shouldn’t have to pay if you were not at fault.
Accident injuries can be excruciating and costly. Don’t forget to see a doctor and document your costs after the crash. You will need to show the severity of your injuries after the accident.
Insurance companies will review all of your evidence after an accident. If you don’t have documentation of your injuries, the insurance company won’t know how to value your claim.
What to Do After a Taxicab Accident
After an accident with a taxicab, there are things you can do to build your claim. We recommend taking the following actions after the crash:
- Report the accident to the police immediately.
- Get the driver’s name, driver’s license number, and cab number.
- Take pictures of the accident scene and your injuries.
- Talk to any eyewitnesses. Ask for their names and contact information.
- Do not admit any fault or blame for the accident.
- Call for an ambulance if you need emergency medical care.
Bring any information you collect to your legal consultation. Your lawyer will use the evidence to determine your options. A lawyer can also help you:
- Collect proof of your damages
- Calculate the worth of your accident claim
- Build and file a substantial insurance claim
- Negotiate with the insurance company
- Fight for the compensation you deserve
Damages from a Taxicab Accident
Any losses from the accident are your damages. When you file a claim, you’ll need to outline each damage and its value. A lawyer can help you account for damages like:
- Medical treatment costs
- Future medical treatment
- Lost income
- Loss of future earnings
- Vehicle or property damage
- Pain and suffering
- Mental anguish
Damages can vary by accident. Also, some damages are more straightforward to calculate than others. Your lawyer will help account for each loss, including those that are non-economical.
