What to Do If You Were in an Aggressive Driving Accident

Emotions are high after an aggressive driving accident. If you were a victim, your safety comes first. Don’t engage with the driver if they are still acting aggressively. Rather, do the following:

• Move your car to a location safe from oncoming traffic (if you can).
• Call the police to report the accident. Tell officers about the other driver’s aggressive actions.
• Stay inside your car until the police arrive if you feel unsafe.
• Write down the driver’s license plate number. Note their physical appearance and vehicle type.
• Take pictures of any injuries, vehicle damage, and the whole accident scene.

Aggressive driving is incredibly dangerous. If someone’s aggression caused your crash, you shouldn’t have to pay. Document everything you can and keep track of your accident costs.

Next, call a lawyer to help with your case. Make sure your attorney has experience with aggressive driving accidents in the Dunwoody area. Your lawyer will use what you’ve collected to start building a claim.

Georgia Law on Aggressive Driving

According to Georgia Code § 40-6-397, aggressive driving is when someone drives “with the intent to annoy, harass, molest, intimidate, injure, or obstruct another person.” The victim of an aggressive driving accident can be another driver, a passenger, or a pedestrian. The aggression is not always aimed at another driver.

Aggressive driving is intentional. The driver is trying to disrupt some way, which means accidents tend to be severe. If the aggressive driver’s actions cause a crash, they are responsible for the damages.

Penalties for Aggressive Driving in Dunwoody

Aggressive driving is a severe traffic violation in Georgia. An aggressive driving conviction is a “misdemeanor of a high and aggravated nature,” according to Georgia law. The penalty can be:

• Up to $5,000 in fines
• Up to 12 months in jail
• Six points on the driver’s license

Fifteen or more points within 24 months can lead to a license suspension. If the accident causes severe injuries or death, the driver could face more penalties. A conviction will also help your case as you fight for financial recovery.

An aggressive driver who causes an accident is responsible for the damages. As a victim, you can file a claim with the driver’s insurance company. A Dunwoody aggressive driving accident lawyer can help you with this and more.

Types of Aggressive Driving

There are many types of aggressive driving actions, including:

• Failing to yield
• Braking suddenly
• Passing illegally
• Ignoring traffic signs or signals
• Changing lanes frequently
• Accelerating quickly
• Using the wrong lanes to pass other vehicles
• Racing other drivers
• Speeding way above the limit
• Tailgating other drivers

If aggressive driving escalates, it can become road rage. Aggressive driving is already serious, but road rage is a clear crime. Road rage means someone is using their car as a weapon. They are trying to cause harm with their vehicle.

Filing a Personal Injury Claim

Serious car accidents can have terrible effects. As a victim, you can face painful injuries, costly procedures, and lost income. This type of accident is often devastating—but you have options.

A personal injury claim might be the last thing on your mind. Instead, you’re focused on healing your injuries and perhaps dealing with trauma. There are also medical bills and other losses to worry about.

This is where our personal injury lawyers come in. We can start investigating your accident to build a strong insurance claim. We’ll ask questions like:

• How was the aggressive driving behaving?
• How did the driver’s behavior lead to your accident?
• What damages have you suffered from the crash?

We’ll work to figure out your total damages from the accident, including future medical care. If you didn’t cause your accident, the current and future costs are not your legal responsibility.

Aggressive Driving Accident Damages

Your personal injury claim can include any losses you have from the accident. Common personal injury damages include:

• Medical bills
• Prescription medications
• Future treatment costs
• Lost wages
• Lost earning capacity
• Vehicle repairs or replacement
• Pain and suffering
• Mental anguish

An experienced lawyer can add up all of your damages, including non-economic ones. Your injury claim should outline all of your costs. That way, you’ll know what type of settlement you deserve.

The other driver’s insurance company will respond to your claim. Most of the time, you’ll get a lowball settlement offer. Our lawyers will negotiate with the insurer for a fair offer.

Without a lawyer, the insurance company is more likely to deny the settlement you deserve. But if they see you’re working with an attorney, the insurance company will know you’re serious. Accident victims with legal help are more likely to get full compensation.
