Who Is at Fault in an Accident with an Uninsured Driver?
Determining liability can be one of the most complex parts of an accident, which is why you need an uninsured motorist accident lawyer in South Fulton.
Unless there is a driver who is clearly to blame, you have to take into consideration all of the factors which may have contributed to the accident. These include things like traffic patterns, visibility, road maintenance, and other external factors.
Police on the scene of the accident will help to piece together details to see which driver will be held liable for the damage caused by the accident. You’ll need this information to establish your claim in court.
Auto Insurance Requirements in South Fulton
Georgia state law requires that all motor vehicles registered in the state must maintain a liability insurance policy with a minimum coverage of $25,000 per person and a maximum of $50,000 per accident. In South Fulton, most drivers carry the minimum insurance as required by the law.
What this means for you, is that if you get into an accident with serious injuries or damages, it is likely that the cost of reparations will exceed the amount of the minimum policy limits. As such, you may not be able to obtain any more funds from the driver at fault without the help of a personal injury lawyer.
What Is an Uninsured Motorist?
If you are in an auto accident, the typical course of action is that the person who is at fault for the accident covers the cost of damages. This is usually handled by the at-fault driver’s insurance coverage.
However, if you are involved in an accident with a driver who doesn’t have sufficient insurance of their own, it becomes more difficult to be compensated for damages and injuries. The insurance coverage of the at-fault person is supposed to compensate the other injured person.
Even if the at-fault party does have insurance, sometimes you’ll experience an accident where the other driver is underinsured. This is true when their policy has a limit below the cost of the damage. You’d need to handle this situation the same way you would handle an accident with an uninsured motorist.

What Happens After an Accident with an Uninsured Motorist?
If you’re the victim of an uninsured motorist accident, the process may be confusing. It is helpful to have an attorney who is experienced in handling personal injury cases to help you to receive the compensation you deserve. An uninsured motorist accident attorney in South Fulton can help you navigate how to proceed.
Each state has laws determining how an insurance case will be handled. Usually, the insurance for the at-fault party is held responsible for damages coming from their policyholder. This means, if the at-fault driver is uninsured, there is no insurance company to claim damages from, and the victim may be expected to pay for damages out of pocket.
In Georgia, our attorneys will help you secure compensation by notifying your own insurer of the accident and injuries. The attorney can document your losses and meet your own insurer’s requirements for an uninsured/underinsured motorist claim.
Things to Do After an Accident with an Uninsured Motorist
After an accident with an uninsured motorist, it is crucial to gather all pertinent information and help to establish who was at fault. There are some important factors to consider and document to help increase the likelihood of receiving full compensation.
Take Photographs
Make sure you take as many detailed photographs as possible. Don’t only focus on the damages and injuries, but be sure to take sufficient photos of the accident scene, including any intersections and road signs. Having this information on hand can provide important information for your lawyer to handle your claim.
File a Police Report
Calling the police will help you to establish order and safety at the scene of the accident, but will also assist you in documenting liability. Even if the accident resulted in minor damage, having a police record is an important document when you need to file an insurance claim.
Document All the Information
Gathering information from the uninsured motorist to include their name, phone, address, and license plate number will make following up with your case easier for everyone. If there are any witnesses to the accident, make sure you collect the same information from them as well.
Work Quickly
There are statutes of limitations for injury-related cases in the state court system, so you want to file your claim and contact your attorney as soon as possible. Your insurance company may have rules about how soon they expect to be notified of an accident as well.
You should typically plan to call your insurance company from the scene of the accident, or as soon as possible thereafter.
Taking quick action in reporting your accident can help to ensure you receive the maximum compensation for your injuries or damages. Our lawyers are trained to help you take prompt steps to get your case handled before any statute of limitations causes your claim to be denied.
