The Legal Implications of Hit and Run Accidents in Georgia
Under Georgia law, leaving the scene of an accident is a serious offense. Drivers involved in accidents must stop, exchange information, and render aid if necessary. Failing to do so can result in criminal charges.
Your compensation claim can be strengthened if the hit-and-run driver is identified and charged. Hit-and-run is a clear sign of negligence; proving negligence is how our South Fulton car accident lawyers prove you’re owed compensation.
Our hit-and-run accident attorneys in South Fulton, GA, are well-versed in Georgia’s hit-and-run laws and how a successful conviction of the driver that hit you could make it much simpler to win your case.
How Our South Fulton Hit and Run Accident Lawyers Will Assist You
In a hit-and-run situation, a lawyer can be your best ally to find routes to compensation when you cannot find the other driver to sue. You need to know your legal options, including claiming money from your own insurance, depending on what policies you have.
If you carry uninsured motorist coverage, it can cover many of your immediate damages. This is often the fastest way to get compensation after a hit-and-run. Should the other driver be found, we can help you sue them for any remaining damages.
You may have other options to get compensation you don’t know about. A free consultation with our team can give you guidance about your situation.

The Importance of Uninsured Motorist Coverage
In hit-and-run cases, uninsured motorist coverage can be a crucial safety net. This type of insurance coverage is designed to protect you when the at-fault driver is uninsured or unidentified in the case of hit-and-run accidents.
Insurance companies are required to offer it to you when you get your policy, but Georgia does not require you to get it. You have to reject it in writing, so the chances are good that you already have this coverage on your policy.
The policy limit for uninsured motorist coverage is usually the same as the minimum insurance coverage in Georgia, but it is possible to buy a larger policy. If your policy is large enough, you may get enough to cover your damages and won’t need to sue the other driver.
Types of Compensation Available in Hit-and-Run Cases
If you’ve been injured in a hit-and-run accident in South Fulton, you may be entitled to the same damages you see in other car accident cases. These include:
- Medical expenses: Coverage for current and future medical treatments related to your injuries
- Lost wages: Compensation for time missed from work due to your injuries
- Pain and suffering: For the physical and emotional distress caused by the accident
- Property damage: To cover repairs or replacement of your vehicle
In cases where the hit-and-run driver’s actions exceeded the average level of negligence, you may also qualify for punitive damages if the other driver can be found. These are an additional punishment against negligent drivers who cause harm far beyond the usual amount.
If you’ve lost a loved one due to a hit-and-run accident, punitive damages could become part of a wrongful death claim if your loved one would have survived had the driver called for medical assistance. These are awarded at the court’s discretion, so it is not guaranteed.
