Insurance Coverage Changes Throughout a Ride, Which Can Affect Your Case
Different insurance policies cover rideshare drivers based on their status in the app at the time of the crash. Here’s how it works:
- The driver is offline or not signed in and using the app: Their personal car insurance applies.
- The driver is online but has no passenger: Rideshare companies, such as Uber or Lyft, provide limited coverage (usually $50,000 per person, $100,000 per accident for injuries).
- The driver is picking up or transporting a passenger: The rideshare company’s policy applies. Georgia law (Ga. Code § 33-1-24 (b)(3)) requires rideshare companies to carry a minimum of $1 million in coverage.
Insurance companies may try to deny claims or shift blame. That’s why having our Peachtree Corners rideshare injury claim lawyers working for you can help. We will challenge insurers and fight for the maximum compensation available.
Who Can You Hold Liable in a Rideshare Accident?
Rideshare accidents are complex because different insurance policies may apply depending on the driver’s status. Liability can fall on:
- The rideshare driver: If the driver was at fault and was logged into the app, Uber or Lyft’s insurance may cover damages.
- The rideshare company: If the driver was actively picking up or transporting passengers, the company’s $1 million policy may apply.
- Another driver: If another motorist caused the crash, their insurance should cover your damages.
- A third party: A vehicle manufacturer, maintenance company, or even the city (for poor road conditions) could be responsible.
These cases require a thorough investigation. Our team will gather evidence, determine liability, and hold the right parties accountable.
