How Will You Calculate My Damages?
The way we calculate damages depends on the type of damage.
Economic Damages
For economic damages, we will calculate how much they’re worth based on the receipts, invoices, and bills you retain. Most economic damages include:
- Vehicle repairs or replacements
- Various medical expenses
- Lost wages and reduced earning capability
These are all easily proven through financial records. Since their monetary values are fixed, we will add them all up and factor them into your settlement.
Non-Economic Damages
For non-economic damages, we have to take a different approach. Damages such as:
- Loss of consortium
- Loss of enjoyment of life
- Emotional trauma and mental anguish
- Pain and suffering
- Disfigurement or disability
These all do not carry any fixed monetary value. Thus, we need to calculate them through a formula. We realize that not all non-economic damages are the same across the board and that one formula isn’t enough to generalize each unique accident in context.
Our approach is both mathematical and holistic. We will consider all of the evidence provided and the merits of your case in tandem with our calculations through various formulas we use. We will also use prior knowledge and precedence when determining how much your settlement will be.
Punitive Damages
If your side-impact collision was caused with intent, malice, or egregious negligence, you could recover an award for punitive damages. Georgia law has punitive damages as a way to punish a particularly negligent party for an accident.
So, for example, if a drunk driver caused your accident and left you seriously injured or with heavy damages, the court may order the drunk driver to pay additional money through punitive damages. While not every case can qualify, if yours does, we will pursue them for you.
The amount for punitive damages varies. Usually, this amount is set by the court, so there is little we can do to calculate the actual total.
What Can a Lawyer Do for Me?
Our attorneys can do many things for you:
- Help you gather evidence and consult with experts on your case
- Interview any witnesses to your accident and recover their testimony
- Organize all of your important documents and retain them for safekeeping
- Handle all negotiations between you and the insurance company
- Pursue your claim to court if necessary
- Handle all communications between you and other parties
- Answer any and all legal questions and provide you with sound legal advice
Additionally, when you retain a lawyer, you boost your chances of winning a settlement. Insurance companies are known to take advantage of personal injury victims and employ many different strategies to get you to settle for less.
A lawyer can protect from any of those risks. More often than not, just by retaining a lawyer is enough to get the defense and the insurance company to settle fairly. Many don’t want to run the risk of fighting a long legal battle only to lose.
Statute of Limitations in Savannah
In Savannah, the statute of limitations follows the state-level time frame of two years according to the Official Code of Georgia Annotated (OCGA) §9-3-33. Two years is only a short period of time to get all of your affairs in order for your claim.
Rushing into your claim is never good, but neither is waiting too long to file. Many people throughout the U.S. miss out on their chance to receive financial compensation because they tried to file past their deadline. We will help you ensure that you meet this deadline with a strong case.
